I tried a search, but it turned up nothing..and I know it has been asked before

Can a non-FFL ship a handgun to a non-FFL resident in his or her state? I know not through USPS...

How and why would this ever become an issue?  Are you selling / transferring a lawfully owned pistol to another?

I'm pretty sure I know the answer, I'd just prefer som concurrency. If I find the right deal yes!

Answer is no.  Unless a FTF deal, it should go through an FFL unless for a C&R purchase.

From the BATF FAQ's:


(B7) May a nonlicensee ship a firearm through the U.S. Postal Service?

A nonlicensee may not transfer a firearm to a non-licensed resident of another State. A nonlicensee may mail a shotgun or rifle to a resident of his or her own State or to a licensee in any State. The Postal Service recommends that long guns be sent by registered mail and that no marking of any kind which would indicate the nature of the contents be placed on the outside of any parcel containing firearms. Handguns are not mailable. A common or contract carrier must be used to ship a handgun.
[18 U.S.C. 1715, 922(a)(3), 922(a)(5) and 922 (a)(2)(A)]


(B8) May a nonlicensee ship a firearm by common or contract carrier?

A nonlicensee may ship a firearm by a common or contract carrier to a resident of his or her own State or to a licensee in any State. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm.

[18 U.S.C. 922(a)(2)(A), 922(a) (3), 922(a)(5) and 922(e), 27 CFR 478.31 and 478.30]

So let's review.  

Rifle, Shotgun ok to ship the across the State to another resident. Or to an FFL out of state.  Either through USPS or UPS or Fedex by law you must declare the shipment contains a firearm but it cannot and should not be marked as containing a firearm.

Handgun, ok to ship to resident of the same state, or FFL in another State.  Cannot be done through PO and UPS requires it to be overnighted. (This is shorten the time for the handgun to be in the hands of UPS so that it doesn't get stolen by UPS workers)

Never hurts to remind people the laws and that you can do a lot more as a gun owner than you think is possible.

Just have to know where to look or ask the right questions.

I have almost had arguments with ass's at fun shows over the laws of this state.  Can't have an argument with a mental midget, so I don't bother.
