New Michigan law taking effect July 1!

On Thursday, March 23, Governor Jennifer Granholm (D) signed House Bill 4642, which allows an individual licensed to carry a concealed firearm to legally carry, possess, use, or transport a firearm belonging to another individual licensed to carry a concealed firearm, as long as the individual's firearm is properly licensed and inspected under this act. This new law goes into effect until July 1, 2006.

So let me see if I understand.

Let say myself, (kdoggy) has a concealed permit. Also my friend (John doe) has a concealed permit too.

John owns a GLOCK 30 and I'd like to shoot it at the range this weekend but John can't get time off work so he can legally say here take my GLOCK 30 with you and its 100% legal as long as both of us have concealed weapons permits and the guns legally registered?

It works really good for my wife and I. We both have carry permits, but all of the pistols (except our Kel-Tec PLR16 which isn't quite a carry gun ) are registered in my name. Now, we don't have to go through the trouble of re-registering them for her to carry.

One thing I wonder though. Does the borrowee have to carry the borrowers green card with them also?

It might just work out like registration for cars... If the LEO runs the serial and finds John Doe's info registered to the gun, and it is not reported stolen, the LEO should assume that Mike Smith (who is in possession of said pistol), with a valid CCW, did not steal it and is borrowing it. Of course, that is a lot of common sense, judgement decision, and assumption and probably wouldn't work in a blue state.

Only the one doing the borrowing needs to have a CPL, so long as the gun in question is duly registered to the person being borrowed from.

Actual text of the law:


Sec. 12. (1) Sections 2 and 9 do not apply to any of the following:

...
...
...

(i) An individual carrying, possessing, using, or transporting a pistol belonging to another individual, if the other individual's pistol is properly licensed and inspected under this act and the individual carrying, possessing, using, or transporting the pistol has obtained a license under section 5b to carry a concealed pistol.
