I was in a beer board class tonight because the marina i work at sells beer, and knox county decided we needed to take a class etc... the subject of firearms came up somehow, and the woman teaching the class said that if you have an off premise" beer permit you cannot carry while at work. My boss has no problems with me having a firearm on my person at work, so there's no problems there... I'm just wondering if this is true. I can't find any pertinant information online, so i thought one of you fine fellows might know the answer. p.s. think gas station... no consumption on site. |
I am not one of the onsite know-it-alls by any means.....but the way I understand the HG Carry law would mean that the above is SAFE to carry in. It's only places where alchohol is served to be consumed *ON* premises where it would be a no-no.

TCA 39-17-1305 is only applicable to places open to the public where alcohol is served for on-premise consumption. It has been that way since July 1st, 2001. In addition, the owner of the property, or anyone acting as his agent (think employee) may carry while on the property, even if they sell alcohol on-premises. (The agent of the owner must have the owner's permission, however.) When I was working as a licensed security guard (rent-a-cop) in Nashville, a couple of our contracts were for providing security personnel at bars. One or two of them allowed, or even requested, us to wear our guns while working. So, the ABC employee was wrong about the law, and had provided your class with incorrect information. |
ah, thanks for that code... i googled it and did some reading... exactly the info i was looking for. She made the statement that her employees at rocky top markets (she's some executive there along with doing beer board classes) are "not legally allowed" to have a firearm at their convenience stores. When i asked her about carry permits she stated that while she wasn't sure about our marina, it was definitely illegal for her employees. She was actually very pro-gun, and said that she wished that her employees could have guns. I'm sure it is a company policy for them and she's exaggerated it into law. question regarding TCA 39-17-1305- If this code is applicable to places where alcohol is served for on-premise consumption, is there some other decision somewhere that allows the carry situation you're describing? The way i read TCA 39-17-1305 and some opinions on it, the reason that our situation would be a "go" is because we don't sell anything over 6% abv. It seems to still exclude restaurant/bar or even liquor store employees. We have a restaurant on site that has a liquor license and i wonder if i can legally carry there if i ever have to go in there for work. thanks a bunch, my boss will appreciate the info. |
