If I am reading this correctly, loaded open carry is legal in Portland if you hold a CHL?

from what i read, it is legal to carry a loaded handgun if you have a concealed handgun permit. i for one would not open carry. your just asking for trouble there, and if you had a CHL why even open carry?

mostly i just was wondering because I open carry around the house alot (ie. front yard). just nice to know the laws and all if i decide to walk across the street to visit the neighbors and such.

plus i gotta admit that seeing the looks on peoples faces at the Plaid down the street or something would be priceless.

I do not know all the laws about CHL, but I did stay in a holiday inn last night.
My understanding, and interpretation of the law is that you cannot open carry in Portland, or Beaverton. Period
The Washington County sheriff(off duty) who gave my CHL class told us that we could lose our CHL if we open carried in Portland, and could do jail time for it.  I don't know if that is true, but why risk it IMO.

yeah thats what my instructor said as well.

I'm still trying to find something that specifically states that.

The statute in the link i posted does not clearly define Open or concealed.

Maybe i'll just call Bernie and see what he says

Not a lawyer, didn't stay at a Holiday Inn Express, but I have read every law (that I know of) the applies to carry in Oregon.

My conclusion:

Open carry is legal in Portland with a CHL.  There is not a single line in any local or state law which says otherwise.

I am so sick of hearing people tell me things are illegal when they aren't.

I double fucking dare someone to prove otherwise.

I don't really like that Portland does not allow open carry.  Doesn't it go against the 2nd with the right to bear arms part?

I don't walk around during the day with a gun on my hip or anything, but I like to put one on my hip every once and a while when I take the dogs for a walk at night.

Yeah, it's pretty silly really. The idea that you can open carry as long as it's not loaded seems really strange to me.

I mean what happens if you should actually need your firearm for self-defence  but it's not loaded due to a silly ordinance.

But, if you go to all the trouble of getting a CHL, your all good for open carry

Check the ORS and then look up the Portland City Code and compare them.  

I'll give you a head start on your googleing.  
Portland City Code 14A.60.010 Possession of a Loaded Firearm in a Public Place.
ORS 166.173 Authority of city or county to regulate possession of loaded firearms in public places.

The reason both Beaverton and Portland have that exemption for CCW holders is because of 166.173.

I didn't mean to be all harsh on ya.  That subject has been discussed at length here regarding which cities have local restrictions on open carry.

The ORS restricts localities from regulating CHL. That power rests with the state.  Hence, the local laws don't apply to CHL holders (along with a slew of other people, cops, soldiers, etc.).  So, it isn't really an opinion so much as it is the law...  as goofy as those are, that one is pretty straight forward.

It should be noted that, while open carry may be legal, it also gives law enforcement agents probable cause to search.  There was a case that went to either the court of appeals or supreme court (can't remember which) wherein a gentleman was waiting on a street corner in the suburbs at 4:00am dressed in camo holding a long gun (duck hunter waiting for a ride).  This gave law enforcement the right to search his home I believe.  At any rate they arrested him for something else they found.

Seems ridiculous but it is what it is.

You start a thread advertising that you have a limited grasp of the law surrounding CCW and open carry.  But you dismiss advice that doesn't fit into what you want to hear (hey, you wanted opinions - if you want to compare resumes and experience in the area, I'm your huckleberry).

I've been carrying a gun for 17 years - I rarely use it.  Doesn't mean I shouldn't carry since I don't use it?  Nothing bad ever happens, right?  

It seems like you've created a paradox for yourself.  

1) You want to carry a gun, so you have a reason for doing so and recognize that need.  
2) You don't think you have to worry about anything actually happening.  e.g. someone trying to take your gun from you when you advertise that you are carrying one because you'll rely on your acute SA to keep you out of trouble.  

So...  Which is it?  
You need it or you don't?  
You accept the risks and responsibilities or you don't?

I can't imagine where that would happen, except in CA or some other Nazi state.  Since you are not breaking the law I don't see how it gives them PC for anything.  If you are out side there would be no reason I see to search your house.
