Hey guys gotta question and being new to GA I have no idea of the answer.

My friend was pulled over this morning cause of her window tint.  She was issued a ticket for the tint and the officer took her lic because she missed a court date back in april.

Since she now doesn't have a lic can she drive with just the ticket she was issued with the new court date?  The officer let her leave the traffic stop and drive to work so I am a little unclear on this.

Considering that there is a law that says you shouldn't drive without a license in your posession, I'm curious as to why he took her license. The only time he should take her license is in the case of serving her with a license suspension (possible if she had a failure to appear) or for DUI.

If it isn't for any of the above, I'd want to speak to a supervisor to find out the reason he took her license.

That maybe true about the suspension due to failure to appear....I dont have all the details yet.  Just got a quick call while she had a break at work.  Ill find out more when she gets off.

If that's the case then no, she can't drive anywhere.

Im very surprised that he let her continue to work.  I got stopped in Suwanee with a double suspended lic and they made me call someone to drive my truck 50 feet into a job site that I was working on and off the side of the road or they were gonna tow it.   What a hassel that was ..... makes me pay tickets on time from now on though, AND put the sticker on my tag when I get it instead of waiting to clean the tag of grease and oil first.

Yeah she was almost to work like seriously 25 feet away. her lic is suspended because of an unpaid ticket. Is there any way to just go to the court house and clear that up the clerk before the court date? Or is there any type of restricted lic so she can drive to and from work until she goes to court?

She will have to go to the court she got the original ticket in, pay the ticket, PLUS an additional fee ( I cant remember how much), they will give her a slip of paper saying that she is paid in full and then at that point she can go to the DMV and get a new lic.  If there was no citation issued at this last stoppage and revocation of her lic she would be clear from that point on.

She can probably clear up the failure to appear now. The tickets she got the other day, she can take care of in a couple of weeks. Just have her call the number on the ticket and she should be able to take care of those without making and appearance.

But in the meantime, she should not drive. The next guy might not be so nice, and it could cost her a trip to jail and a hefty ($700 plus here ) fine.

Sounds to me like an FTA (Failure to Appear) without a service date. By taking her license he gave her a piece of paper notifying her of the suspension of her license. She will need to go to the court that filed the FTA, handle that offense and then go to DDS (Dept of Driver Services) in Conyers. In Conyers she will have to pay a reinstatement fee, and then she can get her license reinstated. HOPEFULLY!!

I was under the impression that for FTA you don't have to have a serve date to charge for suspended license.

FTA is typically a strong reason to make a physical arrest for the traffic offenses, due to the indicator that the violator may not appear to handle that citation.

serve dates are courtesy notifications by the court.  they can be factored into the officer's discretion as to whether or not to force the violator to "post bond immediately".

Good point.  I usually always arrest for FTA suspended license with out a serve date

Our guidance as of Feb 08 was that serve dates are required to make an arrest based on 40-5-121 Driving while License suspended for all but a very few reasons.

As stated above, you can (and in the case of an FTA SHOULD) require an immediate posting of bond.
