This was broght up on a board I frequent. Can a Private business, like Atlantic Station ban a certain type of registered vehicle? I have tried searching Georgia law and I am drawing a blank. |
| Well, that is one thing I do not know. Are the streets inside Atlantic Sataion city owned? They are refusing all access to motorcycles at this time. They are making them park at the Target across the street and are threatening to start ticketing motorcycles for tresspassing within the next month. If the streets are city owned, then there is nothing that they can do. If they are privately owned, then can they still block access to one type of bike? What if the biker is handicaped? Are they then voilating the ADA rules? |
| I dont know the law on this one, But I think that if it is thier property, they should have the right to ban anything they want. Just like you have the right to ban anything you want, that it not a necessary, within your house. Your job, as one of the people that was banned, is to make sure everybody knows thier policy, that it is unfair, and attemp to have them boycot the entire place. Loss of revenue is the number one thing that makes companies change their policies. I would make signs and start a picket line with other bikers to get the word out, Negative publicity is something that businesses dont want. |
If you have hundreds of bikes, ride them all in and see how long it takes them to ask you to leave, one by one, while everybody says, "What? I can't hear you" because of the helmet and engine and such. And first they have to find you. Hurry up and park on the street and go into a restaurant. How would they even find you to give notice? |
Could you ban Black people? Could you just ban Lawyers? Could you just ban Military? Part of being "open to the public" is allowing the public in. I think private entities have much more leeway here then state owner or operated ones, sure, but there still needs to be a non-discriminatory reason. But how could a private entity ticket you? If they take on the forms of government power they take on the responsibilities of government power as well. Remember the private security forces in the mining towns.

Re read the part in red, I dont put underlying statements in my words. It is their establishment, they paid for it, they pay thier taxes and they are responsible if someone gets hurt. They should have the right to ban ANYONE. Just as I posted above, If you dont like it, boycott. In a free market, the business owner should be able to do whatever they want with it. If it is a government contract, or a government entity, then the government should be able to dictate the rules. |

But if they are giving parking tickets they are acting in a governmental capacity and have to abide by governmental restrictions. If they are not giving tickets they still have duties and obligations by opening their establishment to the public. If they are a closed membership that is completely different, but not the case here. Turn it on it's head body dropper, who is making them allow people on to their property at all? However, if they want to open their doors to the public they have assumed some responsibilities. |
