Well, As I promised, I am back and now have time to post about the wonderfull experience with our Goverment/Immigration. First off I'll prefice this by telling you what the standard procedure of our case was/is. Filed petition I-130 alien relative for both my wife and my son (step-son). That was approved and the appointment date was set for September 15th at the Rio De Janeiro Consulate office for the greencard interview. Because my wife entered the country through Mexico, I also had to bring with me the Petition for Hardship Waiver basicaly saying we know that she did wrong by entering illegaly and here are the reasons why she should be let back into the country and here are the hardships if we cant be together as a FAMILY, again key word FAMILY. This is STANDARD I repeat STANDARD oporation and these get approved all over the world at other US Consulates on a daily basis. Basicaly the interview wasnt even an Interview when we got the the little booth with the immigration officer sitting behind a piece of plexiglass talking to us through a microphone. The officer asked my wife 3 questions. 1) How did you meet your husband? 2) How did you enter the US? 3) How long have you and your husband been together? After asking these 3 simple, stupid, and obviouse questions (them having previouse knowledge of all as per the I-130 that was originaly filed). He then proceded to tell my wife that she was bar'ed from entering the United States for 10 years. He then said that after doing fingerprinting which he scheduled for October that they would send those back here to the FBI to make sure she never commited any illegal offenses (which she definatly has not nor ever will) which would take an additional month to get those results back. HERES WHERE THE PLOT THICKENS. After recieving the fringerprints back from the FBI (keep in mind were already 2 months away from this) The HARDSHIP WAIVER would then be sent to LIMA PARU!!!! for approval or denial. That process will take from what he said an aditional 8 months to 1 year or possibly MORE!!! So now were at mimimun 10 months away from here even being able to re-enter the US and possibly 14 months from right now. First quesiton. When every other US Consulate in the WORLD reviews and approves or denies these Hardship Wiavers at the SAME TIME the Greencard interview takes place, why is the Brazilian US Consulate sending these to LIMA F*CKING PARU? What does Paru have anything to do with Brazil or the US? Second, I commited a crime when I was 17 years old, I stood in front of a judge and he reviewed my case and the sentenced me accordingly. I got off easy of course, however my wife doesnt even get a chance to stand trial being the papers are being sent to Lima Paru and I have no way of talking to anyone to plead the case either. How is this fair or even part of America's so called justice system if they are claiming my wife commited a IMMIGRATION crime. Not even a crime that could be determined by a court of law, but by ONE weasly little immigration officer. Now if you are arrested how would you like it if the officer that arrests you to be the Judge, Jurry and the executioner? That wouldnt be right would it? And thats my dilema. Aaron, I'm sorry to hear about your troubles. There has to be a way around this.Maybe not an appeal,but and end run,or if need be,leave your foot print on that petty officals head as you go over it. There is almost always some one higher up to go to,so now is the time to research and get to the next person in the chain of command. | I understand the hardships you're going thru, but that is the state of the immigration process. My wife who has never done anything illegal (ie. enter the US illegally) in her life, nor have I (a US born citizen) even so it took her 15 months after marriage to enter the US. It would have taken even longer if I hadn't talked to my Senator (who actually remembered me from my US Air Force Academy interview) who made a couple of calls to the correct people and she was in the country 2 weeks later. |
Since your wife is not a citizen of the United States, she isn't going to have the rights or provisions of the American justice system. That is what they are going to use to justify their decision. I hate to hear you are having a hard time with this. There must be in place a system that filters the influx of illegals coming into the country. Unfortunatetly, this system sometimes screws over honest people who have made mistakes in the past - and are trying to correct them legally. The US has a horrible illegal immigration problem, and dealing with it usually means good folks slipping through the cracks in the system. Best advice is to write a congressman and let them know of your situation. I can't think of anything else that would do any good. You have to make enough noise to the people that can push it along. |

| Az, the only reason she stayed was because we met, her initial plan was to stay with some friends of hers for a few months and go back to get her son. Then we met and she decided to stay and we'd fight for her citizenship together. We lived together for a year and then we have been married for an aditional year. But do answer your question, yes she entered the country unchecked illegaly and stayed illegaly or I would say illegaly being with me for 2 1/2 years. |

I would guess that event he illegal mexicans here that work hard have more to contribute to our society than you do. No, I am condoning cheap labor. Which helps keep prices low on the items we buy everyday......ie. food, clothing, houses, ect. If we had to pay someone $20 dollars an hour to pick apples, then I would never be able to afford an apple. This influx of cheap labor has fueled our economy for years now. It has raised our standard of living in this country. You should get down on your knees and kiss these peoples feet for what they have done to help this country. Now, I understand some people are upset over the costs being incurred by the educational and hospital systems. The only way to fix that is to get these immigrants to pay taxes. My 2c on this is to get a good lawyer. There are many ways to write petitions to the US Consulate and Immigration to overcome this issue. One interesting (could not find better word) aspect about getting in the US is that there are two different steps. 1) get a VISA through a consulate offshore (e.g. B1/B2 stamp in the passport) 2) get a STATUS when entering the US legally through an immigration check point in the US (e.g. I-94 form) Getting one does not guarantee the other. That is, the Consulate may give you the VISA but the immigration officer may not give you STATUS and you have to go back. Now the interesting part. You may not get the VISA, enter the US illegally and petition for the STATUS through the Immigration (INS), which may grant you one even though you did not have the VISA and got in the country illegally. This means your wife can stay legally in the US but cannot go abroad until getting a Greencard under penalty of passing through the current ordeal. Weird as it sounds, the Consulates and the Immigration are not the same thing and for some reason do not behave in a logical way. I agree that one should not enter the country illegally and expect fair treatment. However, many illegal aliens have far better productive behavior than some US citizens. But life is not fair anyways and the "System" is what it is. A good lawyer will probably charge around $10k (maybe even more since the situation looks screwed up) to get her paperwork in order and advise on the best way to work this situation out. I'd advise to not do anything else, even the fingerprints, before talking to the immigration lawyer. I wish I could give you better news. Good luck! |

You certainly cannot fault illegal immigrants for their hard work and how they have contributed to a portion of the economy that takes advantage of cheap labor (farming, housing, janitorial, etc.) HOWEVER, they have been a massive drain on the social aspects of our economy. Since they are illegal, they do not have health insurance (they probably would not pay for it if they could) so the drain life out of hospital emergency rooms, free health clinics, etc. Savings that you see in your food, homes, etc. are offset by the taxes that you hare having to pay to take care of them as well as the fact that you may have to drive further to go to a hospital since the small one near where you live has closed down since it lost too much money taking care of them...which may very well cost you your life. |
Ya know, for the most part the "GA Gang" is a great bunch of folks. We can have our differences of opinion and still get along. Posts like the one JimmyThompson made are rare around here. I expect that type of juvenile response in GD, not here. Regarding 006’s posts I’ll offer this. A-Train and I talked about his situation on the phone last weekend and I’ve thought a lot about it since then. I’ve come to think of A-Train as a friend. I didn’t want to post in this thread until I gave this a lot of thought because I do see two sides to this story. So here goes. When I look at the problems we have in this country at our borders it makes me sick. The Dems and Repubs alike don’t want to deal with the situation, for different reasons. But on both sides of the aisle they sit there doing nothing. If I lived in Arizona and had illegals walking through my backyard while my government officials looked the other way I kid you not, I’d be sitting on my back deck with my AR & M4-2000 and a shovel. That is how strongly I feel about the issue of illegal immigrants pouring over our borders. At least that is my initial reaction. Why do I feel that way? Point 1: Commit a crime and do no time. Remember a few weeks ago when some guys broke into a pawnshop in Gwinnett County? The responding officers were fired upon. Luckily, none of the officers were hurt. The perpetrators were all illegal Mexican immigrants and part of a very violent gang. They had been arrested previously and had been deported. They just come back a few weeks later to do it again. There are many similar stories. Bottom line, these illegal aliens don’t usually receive the same punishment for violent crimes as do US citizens. They get away easy, IMHO. Point 2: Taking advantage of the welfare system. We all know illegals are taking advantage of our welfare system. I personally have met an illegal Mexican family getting food stamps and money for housing. I’ve first-hand seen illegal Mexican immigrants being given medical care at Gwinnett Medical hospital in front of paying customers. Take a guess what pays for the medical care given to these non-paying illegals? My damn tax dollars! Point 3: Terrorists can move freely over our borders. This is a very real danger and our government chooses to do nothing. Sad. Point 4: Illegal immigrants don’t pay taxes. So, I can have the welfare aid and get a slap on the wrist if I commit a crime. What does this cost me? Nothing. The American taxpayer will pick up the tab. Nuff said. So, my four main reasons I dislike the current illegal immigration issues boil down to a lack of adequate punishment for crimes committed by illegals, welfare abuse, national security risks and tax evasion. So, how does A-Train’s wife fit into these points? I’m pretty sure she isn’t a terrorist. I’m also pretty sure she’s not here to commit crimes knowing she’ll only get a slap on the wrist. I also don’t feel she’s here to take advantage of the welfare system. Has she paid taxes? Maybe, maybe not. But by having a legal status in this country I’m sure that going forward she will pay taxes. So, what the hell is she trying to do here? I’m guessing she wants to contribute to society like the rest of us. I’m guessing she wants a better life than she can have where she was born. That’s the flip side of the immigration issue. I honestly have no problems with people coming to this country to better their lives, as long as they aren’t falling into one of my four bullet points. Yes, my gut reaction to taking the illegal immigration problem into my own hands is easy for me to say from the comfort of my living room hundreds of miles away from the real problem. Would I really do it? I don’t know. When you look at these people like livestock and not human beings it’s easy to turn your back on them and send them back to their third-world shit hole. It’s when you take them time to look at individual situations and evaluate them for what they are that you start to feel some compassion for those people truly trying to better their lives. I truly hope A-Train’s wife will be allowed into the country. She is not without sin in this mess. She did enter this country illegally. But when I look at the reasons she did it and her reasons for wanting to stay I do see a difference between her situation and people like those gang members or people who flock to this country to feed off the welfare tit. So, that’s my take on it. |

First off, let me say that I'm truly sorry to hear about your situation A-Train and I hope you can find a resolution that gets you and your wife back together, where you belong: in these United States of America. Secondly, let me say that this is just one more lesson in the fact that a) the government is not your friend b) never admit to anything (as any lawyer will tell you, "Shut the fuck up") and c) let your attorney do the talking and tango with gov.org when the going get's rough. It's bad enough to have to take the ride but at least you might beat the wrap in the end. Thirdly, in short, when this country was founded there were no border police and there was no socialism. As the U.S. advanced towards socialism and an increase in government control immigration policies and border police followed not long after. Stop feuding over second-handed arguments about who pays taxes and who has a drivers license and who's taking low-wage jobs. Get rid of the fucking socialist bullshit in this country, i.e. welfare, SSDI (social security diasbility insurance), free healthcare by the states, medicare, medicaid, and whole bunch of other handouts and this problem will solve iteself without more laws and more government control. What the fuck do you think gov.org types are squawking about when they cry about illegals "draining resources"? They are talking about their beloved socialist programs they use to buy American votes. Hell, they even print the shit in Spanish to entice people to come across the border and use this stuff so they can bemoan the drain on resources on one hand and reach into your pocket with the other to pick it for more money to increase funding for this bullshit. And please, no "rampant crime wave" or war on drugs nonsense. That's a whole other argument. |

I cant thank you guys enough for your compassion on my situation. Its really hard to find people that are really sympathetic to our situation because my wife entered the US through Mexico. The only thing we want is the same thing every other American family has. To be together and have a fair chance and bettering our lives together through means of working and paying taxes. My wife and I would even like to start a business if we could. She has already told me that she doesnt want to come back through Mexico again becuase then she wouldnt have any papers to properly work. So basicaly I found the best lawyer that money could buy in this area, he has assured me that within 6 months Rosi will be back in the US but it is costing alot of money. Needless to say I'm out of the AR game for a while. My intention was to come back and hookup with another one but after looking after the lawyer and psyciatrist fee's I just cant afford anything right now. I will finish by saying again, thanks for your support and my wife and I could use all the prayers anyone is willing to give. Aaron |

sheese.. what a mess.. good luck getting your wife in. i think aliens should be able to come to this country .. legally. many of the ones i come into contact with who come here illegally seemed to be better than many of the folks that were born here.. but i want a decent process to allow those people in the country.. i want our borders protected.. and i want us to be good neighbors.. i voted for bush because he was the best of the bunch.. the other side is nothing but a bunch of socialists. but what we have now in the national govt is absolute no leadership whatsover.. if the election was held today i would vote bush again.. but the demos are licking there chops.. good thing they are a bunch of idiots. otherwise.. when they ask the obvious question in 40 months or so.. 'are you better off today than you were four years ago?' i dread the answer.. and i pray that whover the repubs come up with can somehow beat whoever the idiot the dems come up with.. but what i really want to see is some leadership.... gas prices and engergy independence? bush' version of the great society (gulf recovery)? war in iraq? nuclear armed iran? no border control? shortage of soldiers? there must be an asteroid comming to end the world and bush knows so the border needs no protection.. let em come. won't matter.. that's the only thing i can figure. |

Heres just a little followup on some things that I've found in doing alot of research for my "hardship waiver" that has to be filed with immigration. This is for anyone that disagreed with me on my "due process" argument that my wife isnt entitled to it because she's not an american citizen. This is strait from the United Nations website and is called the Universal Declaration of Human Rights Article 10. Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him. Article 11. (1) Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence. (2) No one shall be held guilty of any penal offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed. Article 16. (1) Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution. (2) Marriage shall be entered into only with the free and full consent of the intending spouses. Hi A-Train, I hope you understand that I am on your side but....... quoting UN shit to any of us, will not help your cause. I read that paragraph twice and I did not see listed in there anywhere, the belief of the UN that the 2 of you have the "right" (very loosely defined in this case) to live together in the same house, city, county, state, or nation. It says you have the "right" to get married, which you did, but no where does it says that she has the "right" to be in the same country with you. Now please, put the UN shit away and start writing your Senators and Congressman. They are about the only ones that can help you. Write a letter once a week. | Oh I agree about the UN, and my point with that was someone had said that my wife wasnt entitled to due process because she wasnt an american citizen, and that was what I found to combat that. Anyway, that was out of line of me to use UN shit, wont happen again. On the up side, things are going good for me, I have found a website where alot of other people are and have gone through the same thing that I'm going through with immigration and have written letters for the waiver that got approved, so now I actualy have some guidelines so to speak to go by to get this thing approved and hopefully get my wife back in about 6 months, possibly less. So that is good news. |
Uh, Which people are you refering to? The imigrants that are doing all the menial work and the construction work (which hurts my client base btw)? Or the Un,who would love to push their disarmament laws onto us,and are probably the push behind the recent ATF decision to ban import of barrels and new receivers into the country for "non importable arms"? While I don't always agree with Accountants views, I'm with him on the UN, who have long outlived their usefulness as far as I am concerned. |

I still like Bookhound's idea of sitting in Arazona on the boarder with an AR and a Shovel It really is scary how easy it is to cross that boarder, but God forbid your a good person and married to a US Citizen and you got married after you entered without inspection. But every immigration lawyer will recomend re-crossing the boarder again as an option cause guess what, soon those working illegal immigrants will be able to apply for legalization after paying a $1000 fine for EWI (entering without inspection). |
