L. 103-322 repealed 10 years ***after Sept. 13, 1994***, see section 110105(2) of Pub. L. 103-322, set out as a note under section 921 of this title. Section 330011(i) of Pub. L. 103-322 provided that the amendment made by that section is effective as of the date on which section 3528 of Pub. L. 101-647 took effect. Section 330011(j) of Pub. L. 103-322 provided that the amendment made by that section is effective as of the date on which section 3527 of Pub. L. 101-647 took effect. This clearly shows that the ban sunsets at MIDNIGHT on Sept 13th 2004. At one second into Sept 14th the ban doesn't exist. It's not Sunday at midnight, it's MONDAY at MIDNIGHT. Tuesday morning the ban no longer exists. ? But, then again. . . . Okay, since everyone seems to get worked up over this issue, I tell you what I'm going to do: I'm going to shave off another half day. That's right, since you are all nice people, I'm going to show you that the ban expires 12 hours before you think it does. How can I do this, you ask? Look at the definition in Merriam Webster of "year" (as a unit of time): 1 a : the period of about 365 1/4 solar days required for one revolution of the earth around the sun b : the time required for the apparent sun to return to an arbitrary fixed or moving reference point in the sky c : the time in which a planet completes a revolution about the sun <a year of Jupiter> 2 a : a cycle in the Gregorian calendar of 365 or 366 days divided into 12 months beginning with January and ending with December b : a period of time equal to one year of the Gregorian calendar but beginning at a different time. If you take the definition of 1(a), you might notice that 10 years would be defined as 3652.5 days. However, since we've had 3 leap year days since sept 13 1994, we'll have traversed 365*10 + 3 days, or 3653 days between 12:00am Sept 13 1994 and 12:00am Sept 13 2004. So 10 years actually ends a half-day before we think it does, either Sunday at noon, or Monday at noon (depending where you lie on the argument which originated this thread). (Disclaimer: I am not a lawyer and the above reasoning is probably false in some legal sense. I imagine legal documents assume a definition closer to 2 (a) stated above. Any lawyers out there??) |

A calendar year runs from 12:00 am Jan. 1st through 11:59:59 pm Dec. 31st. The first calendar year of the ban ran from 12:00 am Sept. 13th, 1994 through 11:59:59 pm Sept. 12th, 1995. Do that ten times and we've got a shoot on Monday.

Soooo, the day before your 16th birthday you marched down to the DMV and they issued you your driver's license? It was 16 years after the day you were born, right? You were 16 years old as of that day. Nope, monday you show with an assualt weapon, you are committing a Felony offense. It expires the day after its "birthday". It was not signed into law at 0001 hrs on the 13th, and it did not become effective untill 0001 hrs on 9/14/94. BTW Blacks law dictionary is the correct reference, the webster's just confuses things. |

I was born April 20th, 1968. At 12:00 am on April 20th, 1984, I turned 16 regardless of what time I was born. I got my driver's license that day. The AWB was "born" on September 13th, 1994. It will sunset 10 years after the date of enactment . At 12:00 am on September 13th, the ban is dead.
Incorrect...it was enacted on the 13th and enforcement began on the 14th. The law states that it will die 10 years after it's enactment date not it's enforcement date. BTW, a day starts at 00:00 not 00:01. |

Yep, I'll be at CE for sure. kblagg is riding with me. We won't get there until sometime around 11:00 or 11:30 I guess. Hooters is cool with me after shooting. I'll have at least two "new" toys with me (if all goes well tonight). I've got all my "parts" at my sister's house next door. At midnight I'm walking next door to get everything. I've already got four uppers ready to go with the barrels removed. My loweers are waiting for new stocks.

Semiautomatic Assault Weapon Update By statute, the prohibitions relating to semiautomatic assault weapons and large capacity ammunition feeding devices expired on September 13, 2004.
