OK, I know it`s not against the law if you don`t have a CCW to open carry in NC, & you can have loaded gun in car, as long as it`s in plain sight. Question is, if you stop & enter a place were they have signs posted no firearms, what do you do with gun while out of car? Do you put it under seat or glovebox, etc. If so, isn`t it being concealed now because you don`t have a permit?

Technically speaking, it might well be concealed under the meaning of the law if you put it under the seat while you are still in the vehicle and then get out.  However, it is pretty clear that your intent is not to carry a concealed weapon on or about your person.  Since intent is generally required to commit a criminal offense (there are exceptions), it is unlikely you would be charged or convicted on the off chance it was discovered by a LEO.  

That said, getting out of the car with it unconcealed (in a holster for instance), and walking to the trunk and putting it in is likely the safest option legally speaking.  The real solution is just to get a CHP and not worry about such things.

You only have to worry about concealing the gun if its "on or about your person" <- statutory definition of concealed.



Ergo, if you lock the gun in the glovebox, and walk away from the car, it's not concealed, since the gun is not on you or your person.

You can have it in a locked glove box and be driving the car or be inside the car without it being considered "concealed".  As long as its in a LOCKED glove box then you are safe.  I always kept mine within arms reach.  And if I got pulled I would just take the gun and put it on the dash while I was coming to a stop and then put my hands on the steering wheel where the cop could see my hands.  They would just always ask if the gun was mine and I would say "yes" and they would go on about theiir business.  Never had a problem.

Handling a weapon at any time during a traffic stop is a BAD idea.

When u get blue-lighted it takes a few minutes to come to a STOP or as soon as you are safely able to do so.  You don't just slam on the brakes.  I always had the gun right beside me.  So as I was pulling over I would just place it on the dash where the cop could easily see it once he approached the car.  Instead of leaving it beside me openly, which technically is not illegal,  which might spook a cop if he happened to see it next to my leg.  I have never ever had a cop even mention that I did anything wrong or stupid.

This.  Throw it on the dash ASAP place right hand on the top of the wheel, roll the window down and place the left hand on the side mirror.  Whether day or night, take the extra step of turning on the overhead in the car.  When he approaches and tells you to dig for your license and registration, tell him that you'll be glad to, but before you do, there is a loaded firearm in the vehicle.  Usually they ask where it is, you tell them and they'll either run the numbers (if their real dicks), or they'll do what they usually tell me:  "I don't think we'll have a problem - go ahead and get me that registration and your license."

If not that, keep it locked in the glovebox, BEHIND the backseat in a wagon/SUV, or locked in the trunk.  If locked, you're better off in court or in case of assholes if the key you need to unlock it is tied into the ignition key of your car.  Further, as long as it's out of easy reach, you should be good (easy reach being mostly defined in NC as within the "lunge" area of the driver - hence it's okay if NOT locked in something while in the cargo area or very rear of an open vehicle like a Cherokee or such.

Also, in NC it is NOT illegal to open carry if you have a Concealed Carry Handgun permit.

OK sorry - too many double negatives in the original post and mine....

Just to clarify –– >  if you have a CCH you can still open carry.  In fact, I think you can do both, have a concealed handgun on one side and an open carry handgun on the other.  As far as I know there is no law that addresses this so technically it would be legal.  If anyone can site a NC law that addresses this please let me know.

It's legal, and you won't find any laws relating to that.  





Last I checked, laws tell us what we can't do, not what we can do.
