I know that NC is an open carry state... but does that apply to visitors from out of state as well, or only residents? Basically what I am trying to get at is this... I am visiting for a couple of weeks on business, can I open carry? To answer the question before it is asked... No, I do not have my TN Handgun Carry Permit (HCP)... yet. (In TN, you need to have your HCP in order to carry, either open or concealed.) Thanks in advance. |

Don't do it. Its not so much about what you can or cannot do but what you should do. Be smart and don't invite trouble into your life. Most folks will do what is necessary to keep themselves safe. Whether that is legal or not. I open carry in the woods, in my yard and at the medical office my wife and I own. Open carry in populated areas is really just plain ignorant.
Now if you mean open carry in a car, then that's fine. Its the open carry on your hip in public that is going to get attention. |

Gotta agree here..i have never had problems with open carry.... |

Open carry may be legal, but freaking out residents is called "going armed to the terror of the public" It's like...we aren't banning open carry, but if you do it, and people call the police, you may get arrested to scaring people. Something like that. No the legal and lawfull act of OC does not constitute going armed to the terror of the public just because some idiot gets scared pisses his/hers pants and calls the law. |

The problem lies where your well-being may very well depend on some idiot's inability to tell reality from fantasy...as in their unbridled zest for embellishment.
"911 what is your emgergency?" "OMFG THERE IS A MAN...WITH A GUN...AND HE'S WAVING IT AROUND AND POINTING IT AT PEOPLE!!!!!" When the truth is some guy's OCing on his way into the hardware store to buy some lag bolts, a box of nails, and some varnish. People...some of them...are just plain ****ing sneaky and will create any amount of drama to satisfy their need for self-aggrandizement. North Carolina is not Wyoming...or Montana....or North Dakota. |

North Carolina is not Wyoming...or Montana....or North Dakota. thats the point. you can oc in most parts of nc, but it may mean dealing with a hassle, depending on where you take (IE denser pop areas) it you might almost guarantee having to take time out of your day. I would not recommend it unless you are going to be in a situation where its actually likely you will need it. but its your choice |

Quoted: BTW I'm not against OC but I am a big fan of the idea that discretion is the better part of valor. Totally with you on that. It is not a big deal at this point... I pretty much stay at the hotel anyways. The only reason I was asking is if I found myself needing to go do laundry in the evening or something, as I am in somewhat of a seedy area. I cannot CC at this point, and I knew that NC was an OC state... so I was just verifying that I, as a guest to the state could OC also. I appreciate all the response you guys have given. Thanx! |

No the legal and lawfull act of OC does not constitute going armed to the terror of the public just because some idiot gets scared pisses his/hers pants and calls the law. correct, the LEO guide for GATTOP specifically states: "Elements - A person is guilty of this offense if:
(1) he arms himself with unusual and dangerous weapons (2) for the purpose of terrifying others (3) and goes about on public highways (4) in a manner to cause terror to others." my understanding is that all 4 elements have to happen for this to be charged... in the last two years, i have seen it charged 2 times... one was a robbery of a gas station where it was lumped on to other charges... the other was for a guy in a police standoff that threatened the cops with a grenade... |

In SC it's a useless argument because OC is already illegal except for a very limited circumstances. |

I can only refer you to an incident posted to another gun board where a small business owner in in a strip mall the Charlotte area got a visit from local LE after someone called in to report "a man with a gun and he's waving it around". The store was OC and walking from his vehicle to his place of business after returning from lunch. According to what the person posted, the individual who called 911 was a middle aged woman and her teenage daughter. She didn't get arrested (for filing a false report) so the poster claimed but was given a stern lecture. Sorry, but I am unable to provide a link but you're free to spend the next several months searching GT if you think you can find it. My experiece in both marketing/sales and as a reserve LEO I can tell you that I have seen too many people twist and lie and embellish just about anything in order to get their way...or get someone else in trouble. |

Dan Moore in Norfolk VA that has been arrested for OC has been arrested like 3 times... most likely because he is a black man and the LEOs get "black guy with a gun calls"... he won suits the first two time and as far as i know he is still in litigation on the 3rd... the case in GA was a case where someone was open carrying on the train and a LEO arrested him... turns out the train is public property and thus OC cant be banned there... so he won his case too... sorry to argue, but when people become afraid to exercise a right because of the potential hassles, they start to loose that right... |
