Well, guys, I'm headed toward a divorce, and have been for quite some time. I'm completely in the dark as to how I can get this process started from here, but I'm scouring the internet and every state website i can find, trying to figure out the following:
What paperwork do I need? Where can I get it? Can I start this process from a deployed location if I have legal counsel here? My wife and I have been separated since the day before I shipped out, and we decided that parting as friends now would be better than parting as enemies down the road. She's already seeing other people, and I suspect she has been since around April, 2009, but that's all water under the bridge. For my part, all I want is to be out of this marriage, and she seems to be on board with that. There is no animosity here, just a desire to get this finished as soon as possible. Does anyone here have any experience with this kind of thing? I'm stumbling around blindly, and I've been asking questions from one end of Kandahar Airfield to the other, as well as emailing Chancery Court administrators for requests for info, but I've had no luck so far. I'm pretty much at the end of my rope, so any advice or guidance would be greatly appreciated. |

I'm in Mississippi when I'm not deployed. I live in Lamar County, and their Chancery Court doesn't seem to ever answer emails or requests for information. I am planning to do this Pro Se if at all possible, because I write for a living, and do not see the utility of paying someone else $1,500 to simply fill out paperwork with information that we would have to provide anyway. This, on top of the hourly rate is more than I can afford to spend on such a thing, and I have bills to pay that leave me with little opportunity to throw away thousands of dollars.
I would rather start the paperwork process here, so that the rest of this deployment can eat up the 60 day waiting period for Irreconcilable differences divorces. I would like to be able to attend a hearing in August, walk out divorced and then move on with my life. This deployment has sucked goat balls, and I don't need any more of this bullshit piling up back home to be waiting for me when I get back. All I need is some clear guidance concerning how i can get this process moving from here, and I will jump on it with the quickness. |

Worst case scenario, I've seen locally (in Baton Rouge) attorneys offering non-contested divorces for $250 (+court costs obviously), that doesn't sound like a bad rate for someone that knows what they are doing to fill out and file the papers for you. |

If there is something I can help you, be it with forms or what not, please do not hesitate to PM me. The chancery court isn't going to answer any law specific questions. You can do it pro se, ASSUMING that everything, and I mean every little thing is agreed to. If not, and she lawyers up, then I must advise you to attain adequate counsel. If it's a $$$$ thing, I may be able to help out. |

Should be able to go uncontested and will be around $500 or less depeinding on if you need to have a lawyer draw any papers. As far as bieng in afg and filing, I have no idea, hopefully nolo can help you with that. FYI, If you can prove she is seeing other people now and was before then I would suggest to HER she go uncontested as the courts would would most likeley frown on the fact that she did this while you were deployed "ofcourse this is common sense" Good luck and thanks for what you do! |
