Shoot it. 347.03 DOGS MAY BE KILLED.Any owner or caretaker may kill any dog found chasing, injuring, or worrying sheep or other livestock or poultry owned by or in care of such owner or caretaker, on lands or premises owned or controlled by the owner or caretaker, and any owner or caretaker of sheep may kill any dog found on the owner's or caretaker's premises where sheep are kept, not under human restraint or control.if you don't want to kill it: a dangerous dog under 347.50 includes subd 2. (2) killed a domestic animal without provocation while off the owner's property; so, if you retain evidence of that specific dog attacking, you can get the legal ball rolling and have the dog declared a dangerous dog which is strike 1 legally. it gives the owner various legal requirements (347.51) (347.515) (347.52) and if they violate any of them they are guilty of a misdemeanor. (347.55) there is also this little gem: 347.02 KEEPING AFTER NOTICE; PENALTY.not sure if that means that if your turkeys are deemed domestic animals (look I trained him, hes a pet, and lives in the house... I swear when it comes to shooting it, I would be more worried about discharging a weapon if there are laws about that, some asshole cop might not agree with those types of measures to protect a turkey, no matter (347.03) I mean in court the law is very clear, but its still a mess in your life. the man will get involved, keep him on your side. |

I'll add this Subd. 3.Definition.For purposes of this section, "domestic animal" means: (1) those species of animals that live under the husbandry of humans; (2) livestock within the meaning of section 35.01, subdivision 3; (3) a farm-raised deer, farm-raised game bird, or farm-raised fish; or (4) an animal listed as a domestic animal by a rule adopted by the Department of Agriculture. things to remember:
1) document this with a call to police (before you shot the dog, if you are forced to do so.) 2) be aware of your city/town's laws regarding discharge of a firearm. 3) I am not certain, but the DNR may suspect you are hunting if you eat the dog after you kill it, so don't do that. As a gentlemen, I am sure you have made at least one attempt to determine where this dog came from, and tried to notify the owner if it is a non-stray. No reason not to at least give fair warning. |

i'll try to do a back story. i got the home i'm living in now 7 years ago, and we know are neighbor to the east very well. (He comes over just to say hi) Another house is to the north 1/4 mile. (i live in the county, my range is the back yard with a 10x15x15 black dirt pile i shoot into. Back to the house to the north, a family just moved in last spring to the house, renting it. They have 3 dogs that are not suppose to be in a kennel or tied up. ( The owner the house in the neighbor to the east) He came over and told me that if the dogs are running around to let him know. Well he knows about it and is not happen. During the winter they keep there dogs in the house, but now that spring is here i'm hearing the dogs so i know they are getting out a little more, and i'm getting into Turkeys and chickens this year. Last summer I saw the dogs chase deer, geese/eat baby geese and eggs. Those are just the things i've seen. They have been in my yard once, but i didn't have birds than, and now that i do i just want to know what my rights are.
I dont want to shoot a dog but if they get near my birds and i have to pick i will shoot them before they can get into my pen i built for the turkeys/chickens. I also don't want to go to jail for shooting a dog. If they come on my land again my plan is to call the neighbor and Sheriff. Has long as they haven't gotten to my birds. But like i said if they get in there and kill a bird they are going to be dead. I'm sorry but that is what i would do. I'm building a fenced in area for the birds along with a net top so they can't get out and i hope nothing gets in. |
