There was an update on the Minnesota carry bill this week for those interested. We can now officially carry in state parks.

MADFI is pleased to announce the following legal update. In the
interest of serving the entire carry community, we are forwarding this
legal update to all certifying organizations and individual
instructors for which we have email addresses.

The Minnesota Department of Natural Resources, at the request of the
Minnesota Association of Defensive Firearm Instructors (MADFI), has
confirmed that the prohibition against carrying a loaded firearm in
state parks does not apply to, and will not be enforced against, carry
permit holders.

Following MADFI's formal request, Ron Hains, Manager of State Park
Operations, Division of Parks and Recreation, consulted with the DNR's
legal staff and confirmed to MADFI that the carry law overruled the
park rule.

The DNR, through Ron Hains, Manager of State Park Operations, Division
of Parks and Recreation, was extremely helpful and cooperative in
resolving this ambiguity. Mr. Hains has now confirmed, via email to
MADFI, the following facts:


* The DNR officially recognizes that MN Statute 624.714 overrides
Minnesota Rule 6100.0800.

* The DNR has communicated to State Park regional managers that
6100.0800 is not to be enforced against Minnesota permit holders or
out-of-state permit holders with which Minnesota has reciprocity
agreements (currently Arkansas, Louisiana, Utah and Wyoming[1]).

* The DNR will communicate the same message regarding enforcement to
all park managers in the coming weeks.

* The DNR will change the verbiage in State Park signs to reflect this
recognition. Because of logistical issues, this could take some time.

* Minnesota Rule 6100.0800 will, in time, be amended to reflect the
exception for permit holders under 627.714. Because of the rules
revision process, this could take over a year.


MADFI would like to thank Mr. Hains and the DNR for the timely and
professional way in which they dealt with this issue. Their
professionalism should be a model for all levels of government.

Background:

Minnesota Rule 6100.0800[2] states, "While in a state park...it is
unlawful for a person to…possess a firearm, unless the firearm is
unloaded and completely contained in a gun case...or unless unloaded
and contained in the trunk of a car with the trunk door closed...."

The 2005 carry permit law[3], as well as its 2003 predecessor[4],
however, contains no such prohibition, and clearly states,
"No...person or body acting under color of law or governmental
authority may change, modify, or supplement these criteria or
procedures, or limit the exercise of a permit to carry."

Although the statute seems clear, the DNR had not made any definitive
statement about the rule in the two and a half years since the
original carry law passed.

MADFI's directors, believing that instructors, permit holders and
other law-abiding citizens have a right to know the rules, formally
requested that the DNR clarify its position on the matter.

Should have mentioned too. Our permits are now valid in South Dakota. Theirs are not here though. The reciprocity stuff is moving very slowly in this state.

Are they good in any other state(s)...? I've yet to apply for one, but knowing it to be good in SD makes it a bit more appealling.

I can't find a state site that has a listing of where our permits are valid but there is a listing on Packing.org.

Thanks for the link. There are a lot more states that honor our permit, than there are states that Minnesota honors. Odd, but in some way understandable.
