No, they'd more likely do an en banc hearing first where the 2-1 ruling would most likely be overturned. Or DC could choose not to request an en banc hearing or appeal and simply enact another rule/requirement that continues to restrict carry in DC there by continuing the circle jerk all over again. Keep in mind who is the chief judge of the U.S. Court of Appeals for DC. Merrick B. Garland. Yes, that Garland.
