So my uncle used to do a lot of hunting a long time ago and still has a shotgun in his home. unfortunately he never renewed his license. he has offered to give me the shotgun and i know you need the FA-10 form for a private sale but i dont know if it is illegal to make this transfer due to him not having a license anymore??? now im not sure if i want to ask the police what the law is because im afraid he will get in trouble. he doesn't want it anymore and we need to figure this out.

please help

You are right, if you ask the police he might get jammed up in a big way.

What you must do in a case like this is that a licensed person must take the gun with the current owner and "owner-to-be" to a FFL and have the FFL do the transfer. That makes it nice and legal.

Someone possessing an expired FID/LTC can't legally do a FTF transfer via an FA-10 form.
