i just found out today that i was denied my pistol permit because of a firework related charge i got when i was in high school 4 years ago. now i know for a fact that it was erased from my record and that i have a clean background i have been approved for background checks on long guns as well as approved when i got hired at cabelas and again when i was checked for my permit to sell guns in a retail facility at cabelas. im just confused right now as to how long the appeals process can take, whether or not it was a valid reason to deny my permit, and what i can do about it. any help would be much appreciated.

Was it denied by your local chief or by DPS?  If it was your local chief, call their secretary and ask to make an appointment to explain the situation.  One of my friends had his license suspended (breathalyzer refusal) when he sent in his application to Manchester, but he set up a meeting to explain situation to the chief and his permit app was approved the day after the charges were dismissed.

You don't want to go the 18 month wait for the appeals process...

Lawyer up, and immediately file an appeal with the Board of Firearms Permit Examiners. Sure they may be backed up (possibly a year or more) but at least you get your name into the system, you can always rescind the appeal later if the denial is reversed. Also if denied by the local issuing authority call them and schedule an appointment with the person who denied your permit to discuss their reasons for denying it. Its possible that the local issuing authority used the "suitability clause" of the licensing statute to reject the application. Some of the local towns are playing games and being very strict in who they issue the permit to and the BFPE is slapping some of them down by overriding the locals rulings and demanding the permits be issued.

OP didn't mention the town, what town did this happen in?

well first off it was in glastonbury which isnt a too gun friendly town. i just made an appointment to talk to the cheif and im sending in the appeal paperwork tomorow but if its going to ake a year then it would be useless as i plan to be in colorado in a year for gunsmithing school. i hope that when i explain that i was a much different and immature person 4 years ago and now my carreer path is firearms ill explain that i would never in any way violate any law and jeopardise my carreer choice. so to be sure, if they deny it and i convince them im deserving it is possible for them to issue it regardless of the current denial?

Another option is to get the Eligibility Certificate. You apply through the DPS not your local issuing authority. That way you could still buy a handgun and transport it home. However, the Eligibility Certificate "does not entitle the holder to carry a pistol or revolver on their person."

Once you have the certificate try reapplying for the pistol permit and see if the issuing authority will then grant a pistol permit. Should be faster than waiting out the appeals process. Even if you don't get the pistol permit you could still buy handguns and bring them home with the Eligibility Certificate.

All of this of course is predicated on not being prohibited from obtaining a pistol permit.

There is nothing that stops him from obtaining a COE and/ or repplying (1 time or 87 gazillion) for a carry permit while his appeal is pending.

Personally, I don't see much use in him getting a COE, unless he really wants to accumulate pistols in his home.

COE's also do nothing to establish suitability, since there is not suitability criteria in the COE law- only per-se disqualifiers.

In the OP, he mentions it having something to do with a fireworks incident that resulted in charges that were dismissed when he was in high school. I'm going to assume that the denial was suitability related to his conduct (that lead to the police involvement) rather than the (now theoretically non-existant arrest itself).

Yes, it is possible that you can get the permit issued before your hearing date. It is somewhat common with revocations, and it happens every now and then on denials (though it is not so common).

Note that not all gun shops accept the eligibility certificate from what I have heard.

Another thing you can do is go to the court where the fireworks charge was ajudicated and dig around in the clerk's office.  If you can produce paperwork that shows that your case was erased, you will have better luck during your conversation with the chief.

Not necessarily. If the chief was denying based on suitability, he would be denying because of the applicant's conduct- not necessarily the resulting arrest (since there was no conviction, the arrest effectively didn't happen- assuming it was a CT arrest per the erasure statute....HOWEVER, he could use almost everything in the police report to help substantiate his decision- if he wanted)

I had similar problems when I applied for mine 7 years ago.

got denied @ the town because I got a summons when I was 15 for operating a dirtbike on a public road.  Never arrested, never in any trouble other than that...

Used Ralph Sherman.

I rightfully have a permit.
