http://www.fsguns.com/homepage.html There ya go. Go to the used gun page and you will find a decent selection. They dont have any G26's and I dont think your friend will have an easy time finding one, but if he find's two, let me know. |

Look for any pre-10-21-98 Glock (any Gen 1, 2 or 2.5, some early Gen 3's) for sale anywhere in the country. It's legal for them to be imported into MA and transferred by a dealer. Just a hint, if it's a Gen 3 with two pins, forget it. All MA "compliant" Gen 3 9mm's have only one pin since it was before Glock began using the 2 pin setup for both .40 and 9mm.
For a reasonable price, I'd check the classifieds here and other boards looking for an out-of-state sale and have it shipped to a dealer here. It will be a lot cheaper than buying one that's already here and paying an outrageous price. |

The DPS has a specific list of "Approved" handguns which have passed their testing, which is similar to CA's testing. But, the Attorney General back in 1998 (Scott Harshbarger) didn't feel that was restrictive enough, so he passed his own "Consumer Protection Act" pertaining to handguns. By passing it under the guise of "Consumer Protection", he did not need Legislative approval. Under the Consumer Protection Act, a handgun must not only meet the DPS testing, but must also have a second hidden, tamperproof serial number, a loaded chamber indicator or a magazine disconnect, and must not be able to be fired by the average "child" of a certain age, possibly 5 y.o., but I'm not sure of the age. Unfortunately, there's no list kept of what has met the AG's standards. Instead, they "leave it up to the manufacturer" to ensure their product meets their specs. That makes it easier for them to declare any handgun "non-compliant" at any time. Just ask Glock how that one works. So, in order for a handgun to be "compliant", it must be on the DPS list and also meet the AG's requirements. That means that you can buy just about any Smith, Sig, Ruger, Beretta, Para, etc. If you look at fsguns.com, they have a page showing what you can and can't buy in MA. But, there is nothing illegal about owning a handgun that is non-compliant. The only penalty is a $5000 fine for an FFL who transfers it. If you move into MA from out of state and bring it with you, have dual residency, or purchase it from an LEO, you can do a personal transfer of a "non-compiant" handgun legally. Also, if the handgun was made on or before 10-21-98, it's legal to be transferred here. Oh, and for an LEO's individual officer's purchase on department letterhead, the handgun must be on the DPS list, but the AG's rules don't apply. If it's a PD purchasing the handgun, no state rules apply. Confused yet? |
