Decent Reddit summary of current state of AWB: State of play as of today. Already signed April 10. SB27/HB21, civil liability for "industry members" whose acts or omissions lead to public harm. Manufacturers, distributors, FFLs. AG, localities, and private plaintiffs can all sue. PLCAA workaround, same model as NY and NJ. Buyer-side effect is wholesale creep and some smaller FFLs stop shipping to VA. SB323/HB40, Class 5 felony for private manufacture without a serial as of July 1. P80s, Ghost Gunner, 80 percent jig route, all done. Tracks the ATF frames and receivers rule SCOTUS upheld 7-2 in Bondi v. VanDerStok, so the federal courts aren't saving this one. HB871/SB348, safe storage mandate when minors are in the home. Dhillon's DOJ letter named HB871 as unconstitutional alongside SB749, saying it would "effectively disarm residents in their own homes." Spanberger signed it anyway, so there's already an enacted VA gun law on DOJ's target list. Sent back with amendments, Assembly reconvenes April 22. HB217/SB749, the assault firearms ban. Two separate prohibitions in one bill. One, sale, transfer, manufacture, and import of covered "assault firearms" on a definitional list. Two, magazines over 15 rounds, independent of the firearm. A bolt gun with a 20-round mag trips the mag side. Violation is a Class 1 misdemeanor. Spanberger says her amendments preserve "the core," so the heart of the ban is still there. Procedural path. April 22 both chambers vote on her amendments. Accept means signature and law. Reject means the bill goes back to her in original form, at which point she signs, vetoes, or lets it pass. Veto override takes two-thirds, which the current Dem majorities don't clearly have. Realistic outcomes are Assembly accepts or she signs original. DOJ piece nobody outside 2A Twitter is running with. Assistant AG Harmeet Dhillon, heading the Civil Rights Division's new Second Amendment Section, sent a pre-enactment letter on April 10 warning DOJ will sue on signing, explicitly naming SB749 and HB871 and citing EO 14206. First preemptive 2A suit threat in the Division's 68-year history. Not bluster. Dhillon's Division has already filed against LA County Sheriff (CCW delays), DC (AR registration ban), and the Virgin Islands PD (licensing), plus amicus in Rhode v. Bonta and the NJ AR/mag ban case. If they say they're suing Virginia, they're suing Virginia. Grandfather clause, the part everyone asks about. Firearms and magazines lawfully owned before July 1, 2026 are exempt. Keep what's in your safe on June 30, just no intrastate sale, no transfer to a VA resident other than inheritance, and no bringing a new one into the Commonwealth. MA/NJ/CA model. If the final amended text keeps the July 1 cutoff intact, the play is finish buys before then and document pre-ban status with dated 4473s, receipts, and photos. Practical read. VA resident wanting a 15-plus semiauto or a 15-plus mag, buy and take possession before July 1. Don't wait for the court fight, litigation will run 18 to 24 months and the statute is in force the whole time. Already stocked, document everything and finish any stripped lowers before July 1 because in-state manufacture dies that day. Out-of-state buyer wanting a VA-titled gun post-July 1, that's still fine via FFL, just not intrastate. For everyone outside VA, DOJ v. Virginia is the template case. PI granted, MD/NJ/IL/WA/NY defenses get easier. PI denied or DOJ stands down, every D-trifecta copies this language next session. Anyone pulled the trigger on a pre-July 1 build yet, and how backed up are transfers at NOVA and Richmond shops right now? |

It’s a Reddit post. A bolt gun regardless of capacity is not an assault firearm. |

I didn't see anything about that in the proposed changes but I might not have been looking at the right bill. That’s at a minimum what the proposed amendment says. Your pre-ban Glock is an assault firearm because of the magazine (so is it once an assault firearm, always an assault firearm, or it can it be transferred sans magazine?) but a post ban Glock would become one once you insert that 17 rounder and you’re not allowed to manufacture an assault firearm after 30 June. Worse, since the definition isn’t limited to “equipped with a magazine of > 15 rounds at the time of the offense” it could be argued that capacity means “capable of accepting a magazine of a capacity greater than 15 rounds” and then any semiautomatic is potentially an assault firearm. Does owning a post-ban Glock and grandfathered magazines constitute constructive possession of an assault firearm? Only the imagination of the prosecutor, the bias of the judge and the hostility of the jury pose a limit. Dark times. And I want to thank John Roberts and Amy Barrett for this. Thanks a lot, guys. |

The new manufacture/transfer/carry restriction laws say, "with" a magazine capable of 15+ rounds. Common sense would say that means in the gun but VCDL-associated lawyer, Gilbert Ambler, says that legally can mean next to the gun. According to him, worst case scenario on the carry restriction is your spare mag also has to be 15 or less. No justifiable interpretation of the law says capable of accepting a magazine over 15 rounds. Possession of an AW is not illegal so there is no such thing as constructive possession of a grandfathered AW. This sucks, and is unconstitutional AF, but we don't need to jump to the worst possible conclusions as the new reality. |

Possession of an AW is not illegal so there is no such thing as constructive possession of a grandfathered AW. This sucks, and is unconstitutional AF, but we don't need to jump to the worst possible conclusions as the new reality. I’m not talking about grandfathered AWs, but about preban grandfathered magazines with otherwise not prohibited post-ban guns, for example a 17 round magazine in a Glock you buy a year from now. Possession isn’t prohibited but under HB217/SB749 manufacture is, and if inserting a magazine of greater than 15 rounds makes an otherwise featureless weapon into an assault firearm, how is one not at the moment of inserting the 16+ magazine manufacturing an assault firearm? And if you have pre-ban large capacity magazines with no pre-ban gun into which to put them, what are they for except to manufacture an AW? ‘But yer honor I never actually loaded them!’ The law as proposed doesn’t specify ‘equipped with.’ The ‘equipped’ language is being struck out of the statute. You’re hoping that’s what they mean, and if they weren’t striking that out I’d feel better about it, but they are. They must have a reason for it and we can be sure it’s not to our benefit. Take the example Glock 17 - it’s not an AW by features, but because of the magazine, but the magazine is detachable. Does the weapon shift between AW and legal status when you remove or insert the magazine? Or does it retain the quality of AWness? If the latter then you’re clear to keep using your 17 round magazine in your pre-ban gun, but not in a post-ban gun; if the former it’s unclear but presumably prohibited to use your 17 round magazine at all. Somewhat ironically it would continue to be perfectly legal to use your preban magazine in your preban Stribog or MP5 or AR because you won’t be manufacturing a prohibited weapon by inserting the LCM. Accuse me of catastrophizing. I hope you’re right, but the absurdity and ambiguity of the governor’s amended bill invite creative enforcement and prosecution. ETA - this isn’t unconstitutional. The blue states have thrown down the gauntlet since Bruen and SCOTUS has pointedly refused to pick it up. Unless they do, and I’m not holding my breath, half the states are going to have similar bans soon. |

I just saw a post on Youtube from GOA saying that, Gun Owners of America 23 minutes ago (edited) 🚨VA UPDATE🚨 The VA Legislature did not accept the Governor's amendments to the Assault Weapons Ban. This puts the original bill back on her desk. She has 30 days to sign, veto, or let it become law without action. Our lawsuit is ready to file when the dust has settled. |

I’m right behind you guys. I just signed a contract for a house in my home state of NC. I’ve been in Virginia for 29 yrs and seen it go from the Commonwealth to the Commiewealth. These Leftists are like locusts. They destroy their state and then come for yours. |

I was a refugee from NY, not a missionary. The BS there followed me to the Commonwealth. Hoping to be in a free state by 2027. To put things in perspective, my local Costco is selling marinated goat cubes. I went there yesterday evening. If a tuk-tuk was going down the aisle and someone shitting in the corner, I'd swear I was in Mumbai. |

Soros and Bloomberg are pledging to turn each state and pumping millions into each election one state at a time. NC is coming next and they're already on the verge of falling. Matter of fact they had a permit to buy handgun for years until just recently but it'll probably yo-yo like how Virginia is. If you didn't vote this election or running away, may your next fall be swift and hard. It's coming to every state until a stand is made. |

I certainly did not consider pre-emptively bending the knee and surrendering like someone I remember when these same measures were proposed under Coon Man. |

So if you want to have a purity test, I’d say that me and a lot of others are a lot more ideologically pure than you are. We’re just not the blowhard on the internet that you are. |

Oh wow you are so tough leaving the state too lol. Hey don’t ever come back to Va we don’t need you. Also kiss my ass man. My dad passed awat and suddenly the AWB came and I was in complete panic I was going to lose my guns at the time. Now I’m clear minded and there’s no way in hell I’m giving up anything or moving. So good riddance. |

So good riddance. I seem to recall in another thread where you expressed that you would like to move to NC, but that your mother is still in VA and you did not want to move away from her. That is a perfectly good reason to stay and very much the reason I am leaving. I got an opportunity to retire early from the Federal government which allows me to move back to where I grew up, and be closer to my mom in her later years. Escaping the tyranny in VA is a secondary benefit. Just because people are not “staying to fight” like you is not a reason to jump on them and call them a “clown” and “ass” for leaving. Given your past statements and history, you are hardly in a position to criticize others’ decisions. If circumstances change and you decide to move to NC, then you can help keep NC from going commie, but don’t be an ass to everyone else as they are on their way out of VA. |

The problem is you’re accusing me of thought crimes. Yes I tried the bullet button and got 10 round mags to test out. Yes I encouraged others to try. Yes I thought of and researched the cost of moving to NC. None of which I’m actually doing after thinking carefully and saying to myself wow this is dumb. However you’re actually moving to NC along with the other clowns here and saying you’re actual “pure” at heart because somehow I’m not. So as I said don’t let the door slam you on the ass on the way out. You’re a horrible person and even worse you were never pure just as soon as you leave. |

Has it occurred to you that people move for reasons other than just avoiding gun control? I’m moving to be closer to family. You regularly attack people on here for what are pretty rational posts while having made some pretty dumb ones yourself in the past. Have some humility and lighten up. You’re not going to win any fights by attacking people who are ostensibly on your side. |

Perhaps but if you’re moving for family reasons or if I’m staying for family reasons then why bring it up at all if you’re ostensibly on the same side? Point is yes I have made bad posts and good ones but the truth is I never left Virginia. Now you say I have made bad posts which implies that you made a bad post here. Did you make a bad post post that you’ll be leaving Virginia and instead will be staying? Or are you now trying to go for the family angle which earlier you did not imply or stated? |
|
We’ve all made bad posts on the internet, myself included. I’m just using your past words and actions to hang you with your own rope. Your first post to my post declaring I signed a contract on a house in NC included the following: “If you didn't vote this election or running away, may your next fall be swift and hard. You pre-supposed that I didn’t vote in this election and am in part responsible for things and then you assumed that I am “running away.” You then went on to wish ill will upon me and the people of NC because I am choosing to move back there. You yourself have told all of us (and everyone else on the internet) that you voted for Obama and Democrats in the past. Similarly, you posted just a couple weeks ago that you were considering moving to NC to escape what’s going on in VA. I don’t believe I or anyone else needs to explain the rationale for leaving, but again, you are hardly in a position to judge. Now if you feel guilt for your own past voting record and “impure” thoughts about moving, that is on you. Don’t try and lay that guilt on me or anyone else. And don’t go preaching fire and brimstone from the pulpit if you yourself are guilty of the same thing or worse. Further, I don’t “police thoughts,” as that is a very Leftist thing to do, but if you don’t want others to”police” your thoughts, don’t go posting them so readily on the internet. My only point in bringing up your past statements is to illustrate your own hypocrisy on the very subjects you wanted to attack me on. Hopefully you will do some self reflection and stop jumping on people for things you disagree with, particularly if your own conscience is not clean on those matters. |

Running to a “free state” will only delay the inevitable. States are falling like dominoes thanks to massive infusions of Bloomberg/Soros $, DEMOGRAPHICS, and the reluctance of the former Grand Old Party (and gun owners) to fight. |

My local local gun shop / range posted that all transfers, consignments, purchases, etc for weapons impacted by the ban need to be completed by 6/15. The owner of another local shop plans to transport any impacted inventory to his place in Florida. F'ing window is closing thanks to the a$$holes in Richmond. |

But even in ban states, there are businesses that will sell up to the limit of the law. Lived in a very restrictive state for a decade and was always able to get the parts I needed, even though that state's AG sent cease and desist letters and lawsuits at some other companies. |

I don’t know if Nick is really leaving or staying but I wouldn’t blame him if he did leave. I LOVE Virginia. My children are native to the soil. However, Virginians have done this to themselves. The numbers are still there, it’s just that “Right” thinking Virginians won’t show up to the polls. November should have been not a “wake-up call” but a goddamn FIRE-ALARM to Virginians who give a crap about their freedoms. Instead the April Special Election revealed that still more than half on the Right are content to continue sleeping in their burning beds. Yes, blame the Democrat’s cheating machine, blame Bloomberg and Soros’ carpetbagger money, blame illegals and Liberal transplants in NoVA, but if the MAGA-AF voters who turned out for Trump in 2024 could have been bothered to vote in 2025 or 2026, Virginia would now be a much different political landscape. |
Life is short. If you are waiting for “someday”, it’s here!
