Florida is always one or two elections away from the same fate as Virginia but I am hearing the same old TL,DR excuses; “it will never happen here” “the Governor won’t let it happen” “Republicans control the Legislature” “I got mine” “will not comply”.

BTW- regarding COSTCO, last time I was at the Chantilly location, I saw grown men spitting on the floors and from the smell, likely pissing in the corners. Mumbai, indeed.

Yes I have heard those up to the election last year when I was at the ranges in my area to talk to people and telling them to vote. I got the “I got mine” and “nah, it’ll never happen here.” When I said the AWB passed two years already and it only needs a governor to sign it, I got just death stares or complete “nah they’re just trying to scare you.”

So yes, other states are currently in denial and many states are a few steps closer to dem control. I do not believe anyone can do anything about it and even with a scotus ruling in hand it might take decades to enforce. It took over half a century to desegregate schools after the big scotus decision and many consider that something both parties want.

Heads-up, we got an ATF request for photos of an NFA firearm to verify if it is legal or not in Virginia. I'm sure there will be more of this after July 1st.

note,  I have had NFA branch reach out on some stuff wanting pics etc to clean up the NFA database,

usually a pic of the serial, and a pic overall next to a ruler or yardstick to verify length was good

It seems Florida has been trying to make the state unattractive for liberals, a concept I can completely get behind.  To some degree Tennessee has as well.  That's really the key.  It's not enough to be a conservative and stay quiet.  You have to work to institute tenants at the state level.  Unfortunately, it's hard enough to get conservatives to care about the primaries which is the most critical step in the process.

I'm still confused.  I have a bunch for F1 SBR submissions.  Should I anticipate them all getting rejected because of rules that haven't taken effect yet?

No sometimes they might ask for a picture to see if it is in a legal configuration and documentation. SBR ARs and such probably not but something like a SBS might.

It could be post July they might ask for a picture before approval since to my understanding you can still have NFA items just not in the “illegal” configuration. So in theory you might still be able to get your SBS post July.

I am not a lawyer nor an FFL, but I would expect ATF to deny Form 1's for anything Va claims are AW's, after July 1st. It's stupid, but it is the most likely outcome.

It is hard to tell.  DOJ and ATF are about as friendly as they have ever been, and there is no specific restriction on SBRs in the law.  One might need to show it was owned before 7/1.  Plus why would the liberals want to ban people registering their guns.

I could see it go either way as poorly as the law is written.

Picking up a lower and my ffl said for the last three weeks, most of the psa lowers coming in have been in 3 packs.

Got to love the fuck you spammy attitude.

Lol. Just spoke with an older guy that said the nra has a lot of pull and these laws wont take effect. Didnt realize there were dumbass' that still believed the nra fought for the 2A.

A also was in grasping the fact that we live in the fourth circuit and they've already ruled that assault weapon and mag bans are legal. He couldn't grasp the fact that assault weapon and mag bans are here to stay forever in virginia

Other than the rare judge like Benitez, there aren't many circuit courts who have knocked down bans.

let me preface this by saying I expect NO help from the court.

That being said - the VA supreme court leans right as of now. 2 of those "conservative" justices will be replaced in 27 and 28 IIRC. Im watching the redisctircting. If they strike that down, then I do wonder if they extend the middle finger to the GA and do something about the AWB and associated laws. Those two will never sit on the bench in VA again after the dems replace them. This GA will load the court with the most liberal judges they can. If they are being replaced, they may yet middle finger the GA on the way out. I know I would, because va has gone full legislate by spite.

I dont know how these legal challenges with guns start. Tazewell? Do they start state then go federal when you lose at the state level? The va constitution has a RKBA clause. I'm guessing these will see both state and federal challenges. And I don't expect to see any positive results, but if we do win the redisctricting thing, it might show signs of a "fuck you" coming from the VASC

From what little I've paid attention, and I admit, it has been very little over the years, The Va SC is a bunch of pussies. I do not expect them to overturn the will of the people know matter how much of a fuck you the Dems did with the Va constitution in regards to the redistricting. As for gun bans, I don't expect them to overturn any of them and if they do, 2 bullet Jones will just go whine to the 4th circus that will reaffirm all gun control is legal.

Basically without a gutting of the SCOTUS and having 9 Thomas' sitting on the bench, there is no relief coming from the courts.

Yes, even if we win the SC in Virginia, it can be appealed in higher courts that would eventually find it legal. It seems like weekly on Youtube gun channels are pushing the narrative about magazine bans that got overturned, or how some AW bill got overturned but I don't ever see anything changed and the next week whatever ruling was made was overturned or moot.

I think the biggest challenge to the AWB was with the NYSAFE act and the provision of the NYC pistol ban. It was so close that NY had an emergency session to write that part out so it wouldn't go in front of the SCOTUS. And even with an overturning of it in the SCOTUS, there's a good chance it will take decades before states follow through. Even Brown vs Board of Education took multiple decades to get fully in effect with the last de-segregated school was in 2016. So let that sink in for a second with such an important issue as segregation taking that many decades to overturn, imagine for a second what AWB overturning might look? California might never see it overturned and it would have to go through numerous courts for decades before finally getting overturned. Virginia, unless there's a GOP control again, it will probably never get overturned.

The new law bans possession and purchase of handguns and whatever assault weapons are for the age group 18-20 year olds. The gov added verbiage without the general assembly approving background checks to start again as a public safety emergency. She said it is to start when she signed the bill. The VSP has since said they will not do any background checks for private sales until the previously law found unconstitutional by that circuit court judge until straightened out by the courts. The state police cannot enforce what the gov says or they will be contemplating the court if a judge has ruled it can no longer be enforced. That is the purpose of separation of powers of government.

Read their website. Ask any of your Virginia FFL’s you visit. Supposedly the VSP sent them all notices after Governor signed this bill stating they would continue not doing background checks on private sales.

June 23 is Palmetto State Armory’s cut-off date for all VA orders. No final word yet if parts will be shipped to VA.

Bought another MP5 because Spammy says I can't have anymore and it needs to be an sbr. Probably pick it up next friday and form 1s are running over 60 days it seems.

I have not seen anything definitive.

I did see this post where a VA resident appears to have received a batch for several forms submitted over a month (including into April):

The ATF is not responsible for enforcing State laws, so maybe they will approve Form 1 and leave it to the applicant to comply. The applicant could move to another State, or there might be an injunction against the new AWB. Either of those might allow an applicant to make their firearm.

The AWB in VA is similar to the WA one and in that situation the ATF simply dropped everyone and at the time gave back the $200. The problem is when you make an SBR, or ask for an SBR, it's the same as getting a "new" rifle even if it is from one you already owned so it is considered "importing" a new rifle thus a violation of the new law.

I do believe suppressors will still make it through because it's not part of the AWB. But SBRs might depending on the features. They'll likely ask for a picture of said rifle and then reject it if it has any of the banned features.

Assuming this is all after July 1st. If you make it before hand, you're solid and good to go.

Bad news... well maybe news we already known... but the governor signed the AWB bill into law yesterday and as such she is fully on board with it. So it is no surprise I guess and we shall see what the coming lawsuits will do.

WA residents are still able to form 1 their SBRs post ban, though some get denied to misunderstanding or bad adjudicators at the ATF. Not sure how VA will play out but I’m hopeful that the form 1s will still go through, and am aware that the WA and VA bans are very similar with some varying language.

And naturally I want to believe this as I find the ban complete bullshit
