Ok, so I'm not exactly a noob too the NFA game, but have a queston...
Has the ATF changed VA requirements when it comes to including a Schedule A when sending in a trust for a F4 transfer? I have two other stamps and have not submitted one. A guy behind the counter who gave me my paperwork told me today that they've had a few guy's forms kicked back recently for not submitting a Schedule A. What say the Hive? ~WTS |

Well, just for the record, I talked with my attorney today, and he said he is not aware of any such requirement, and stated that I should send my trust in as normal. And if it does get rejected, then he wants to see the letter.
I'm gonna test the waters on this one....Worst case scenario, it adds a week or two to my wait

A couple years ago, the BATFE decided they wanted to see schedule A's because some states (not all) require that trusts be funded in order to be valid. Since the BATFE are just like any other government organization, it's easier for them to simply make everyone do things the same than it is for everyone to do it the right way. So now, they want to see a Sched A with something on it or they will determine that it's an invalid trust. The item listed is funding the trust, and it can be anything. Previous NFA items are not necessary.
There's no reason not to send one in, it's a seperate page that looks like this; Mr. and Mrs. Two Car Garage Revocable Living Trust Anytown, USA Schedule A Swiss cuckoo clock That's it. The clock can be anything, and it funds the trust. I added an ammendment to my trust that states that all trustees agree no compensation for duties is required. Probably overkill, but it protects me and my beneficiary from a (highly unlikely) greedy trustee down the road that wants a piece of that trust fund. |
