Looking for someone in the Blacksburg/Christiansburg who has set up a Revocable Living Trust for their NFA items. If you have set one up for yourself and can share your experience (good or bad) doing so I would appreciate a bit of your time. I have bought a couple books and done all the research I can. I believe I have it worked but would like to bounce it off someone who has successfully filed a Trust w/ the BATFE.
Feel free to post here or IM me if you would prefer. I am not asking anyone to provide legal counsel or to practice law without a license, just hoping that you can share your experience with the process. Thanks. |
| It was a pretty straight forward process for me. I talked to my gun store owner about setting one up while I was in the process of buying my first SBR. He pointed me in the direction of the attorney he used to write his up. All I had to do was list the folks I wanted to get the item(s) after me, and if there was any special stipulations to the trust itself. I'm pretty sure he copied a generic one from a book and plugged in the folks that I assigned him. All in all I think the attorney is the way to go, if youre able to afford it. Luckily the one I used is a gun guy so I made it out of the office with only 2 visits and only had to shell out about 275 bucks. the whole thing was notarized and ready to go after that. I stuck it with my Form 4, (SBR was a factory complete gun) wrote the description of the item on the schedule A along with the serial number and sent her off with my 200 bucks. Ive been pending since Febuary 3rd, and I dont anticipate any problems. I feel like this is the best way to do the whole class 3 thing, being that I have a 200 dollar 1 time fee to have the trust, and all I have to do for the next item is describe it, fill out my Form 4/1 and send it off with my tax fee. Should I ever need to update the trust, I'm sure it wont be expensive at all. |
| I just used Quicken Willmaker. Did the generic trust, and it worked; I have a few SBR's and suppressors. Wish I could afford an MG. I would not use this for transferring property to my heirs, etc., but I just wanted one to get some NFA stuff, and it has served its purpose admirably. |
