I was looking at a M&P15-22 today. I was told that it is not considered a assault weapon and dont need proof of citizenship? I was also told that some AR-15s are not considered assault weapons if they have magazines that hold less then 20 rounds. Is that true?

It's not considered one because it's not centerfire.

"Assault Firearm" is defined as any semi-automatic center-fire rifle or pistol which expels single or multiple projectiles by action of an explosion of a combustible material and is equipped at the time of the offense with a magazine that will hold more than 20 rounds of ammunition or designed by the manufacturer to accommodate a silencer or equipped with a folding stock.

It's VA State Law. Has nothing to do with the feds.

I purchased this same rifle and had to show proof of citizenship and full background check.  My rifle came with a 25 round mag.  I noticed that S&W now lists the same rifle with a 10 round (compliant) mag.  Not sure if my local gun store went overboard on the check or not???

This question has been done over and over!

Enough to say some gun stores make up their own interpretation of the rules then bitch about regulations
