Virginia Veteran Wins Battle to Keep His Flagpole in Yard



RICHMOND, Va. — A 90-year-old Medal of Honor recipient can keep his 21-foot flagpole in his front yard after a homeowner's association dropped its request to remove it, a spokesman for Democratic Virginia Sen. Mark Warner said Tuesday.

The Sussex Square homeowners' association likewise has agreed to drop threats to take legal action against retired Army Col. Van T. Barfoot, Warner spokesman Kevin Hall said.

The association had threatened to take Barfoot to court if he failed to remove the pole from his suburban Richmond home by Friday. It had said the pole violated the neighborhood's aesthetic guidelines.

Neither Barfoot's daughter, Margaret Nicholls, nor homeowners' president Glenn Wilson immediately returned telephone messages.

Dropping the issue effectively ends a request that White House press secretary Robert Gibbs on Monday called "silly."

Warner and Sen. Jim Webb, both Virginia Democrats, had rallied behind Barfoot, a World War II veteran.

In a letter last week, Webb urged the association to "consider the exceptional nature of Col. Barfoot's service when considering his pride and determination in honoring our flag."

Barfoot's fight also has lit up veterans bulletin boards and blog sites supporting him.

Barfoot won the Medal of Honor for actions while his platoon was under German assault near Carano, Italy, in May 1944. He was credited with standing up to three German tanks with a bazooka and stopping their advance.

He also won the Purple Heart and other decorations, and served in Korea and Vietnam before retiring from the service in 1974.

gonna catch flak for this but.

you guys are happy because someone that moved into a HOA, signed the rules of said HOA which stated no flag poles, went in front of said HOA BOD to request a flag pole and was denied, still put flag pole up braking the terms of his HOA agreement and after being rejected? do i have that right?

HOA did not have a rule against flagpoles. They claimed the flagpole was aesthetically unappealing. Which seems to be the catch all for HOA to make sure you are a good stepford homeowner.

they told the man he COULD NOT HAVE A FLAG POLE. doesnt matter, he broke the rules he agreed to live by when he moved in. HOA had no balls and backed down. if you dont like the rules of a HOA DONT MOVE INTO ONE. dont move into one then do as you please and then bitch and moan about them doing what they do, enforcing the rules. it would be different if he had put the pole up then the HOA going to him and telling it to take it down, but he went to them and asked, they said NO, and he put it up anyway.

I won't give you any flack,  I agree with you.

Besides that the guy is living in a condo association.  The grass where he put the flag pole is not his front lawn it is common grounds.

He bought the house there, agreed to live by the rules.  Asked for permission to put up the pole, was turned down, the HOA said he could fly it on the front of his house like everyone else and then he went and put it up anyways.  Then he went to the press crying because the HOA demanded he take it down and he was just trying to be a patriotic war hero.

Now I hate condo associations, lived under one for 5 years, will never do it again. I was fighting with them constantly and even went to court and lost against them.  They even tried to fine me for my dog crapping on the common grounds and me not cleaning it up.  Only problem with that complaint was that my dog had been poisoned 2 months prior to the date he was supposedly seen crapping on the common grounds.  When I bought my home 21 years ago the first thing I told the Realtor was if it has a HOA don't even bother showing it to us.

I don't think we should have one set of rules for war heroes and another set of rules for everyone else.
