I know signally flares and smoke flares are generally legal in most places, because they usually fall under an emergency device clause. Buying smoke grenades becomes as easy as buying road flares as a result.

I'm curious, however, if similar legal standings exist for riot agents, like tear gas, in light of the fact that Mace (which is aerosol CN) and pepper spray (OC and the like) are legal. In places with no restrictions on things like pepper spray would the same legality apply to tear gas greandes and such?  How does it work specifically in VA?

I know, its a totally random question, but I was talking about it with a friend a few days ago and now I'm really curious.

I believe they are legal to own, but no manufacturer is going to knowingly sell to someone who sells to the public (think of the liability).  Therefore, supply is low and prices are not.
