I live in TX, I have a friend in IL. He's got no real "play" money, and I want to buy him a 1911 he's been eyeing
He doesn't own any guns, and therefore hasn't yet got his FOID. I told him to get it, that way if he ever does want to buy it, he wont have any issues, since it's only a $10 fee. My question is, how soon are FOID card apps/renewals coming back? And is there any problem with me buying a pistol online to be sent elsewhere? I dont know what the ATF's rules are regarding that sort of thing. it isn't a straw purchase, he's filling the 4473 out. I just want to (if possible) keep this whole thing a surprise. call him and say "hey go to so and so's shop and tell him you have a 1911 waiting for you, here's the address" TL;DR - How long are FOID's taking? Can an out-of stater pay for a pistol to be sent to IL to be picked up by an in-state FOID holder? Would I need a photocopy of the FOID? Both sides? |

I know he needs his foid, and i know he needs to fill the 4473. rest of you guys are saying around 60 days (between this thread and GD) so that's not too terrible. |

The OP clearly was asking about sending the gun to instate FFL for the friend to take possession after he got his FOID. There was never any mention of wrong doing... Good on him! |

I assume that the OP above was concerned about breaking the law in regards to straw purchases and the Supreme Court ruling in June of this year. In that case, both parties were legal to own firearms and one gifted a Glock 19 to a relative and inadvertently broke the law, according to the Supreme Court.

I don't know the particulars of that case but, I doubt that the gifting went through an FFL in the recipient's home state. |

OP checking in - the only "straw purchase" concern I have is in regards to me paying for it from out of state. i didnt know if that counts, never had any reason to care, or look into it. responses seem to suggest i am gtg to buy it, he just needs to fill out the 4473, since he will be the owner (as i assumed would be the case)
So, I guess we just wait for him to get his FOID card in a month or three. When he does, the only way I can really make this a surprise is by calling a shop near him, buying said pistol, over the phone, and telling them "hey im from texas, being nice for a friend, his name is john doe, and he's about yea high, I'll send him for his 4473"? |

To be honest I don't know if that was what the OP was talking about. But the idea of purchasing a firearm from one legal owner to another legal owner and the word "straw" attached to it, reminded me of that case.
I don't know much about the case. I just remember when I read the article on CNN it sent red flags for me, because I've know people who purchase fire arms for their kids (20 g shotgun or 22 rifle) and thought that the ruling didn't seem "right". But since it hasn't come up in my life yet, I haven't researched it. |

I'm understanding the Supreme case was a nephew buying a gun for his legal to own a gun uncle with the uncle's money and transferring it to himself and giving it to said uncle. Actually, that wouldn't sound like any breach of law since they are both legal to own guns...but, I guess it was ruled otherwise.
What is different here is it is actually a gift and the recipient will be filling out the form....An explanation call to the FFL would be prudent before making it happen but, I think he is good to go! P.S. I appreciate the civil conversation on this subject... |

Not a straw purchase. Just because OP pays for it online it is not his. My FFL told me before, he doesn't care who pays for it, it is whomever fills out the 4473 that it is transferred to. When I purchase things online it is transferred to my dealer and it's not mine until I fill out my 4473 and being approved.
Edit: Just making sure OP that we are talking about the same thing. Your going to order and pay for a 1911 online and ship it to an FFL in Illinois in your friends name? If so, I don't see an issue with that. |

Although I have never done it, I would assume yes...They only ask for the FFL to send it to. you would want to check with the retailer/manufacturer first to see if they have your local shop's FFL on file if they do not you can mail/email or fax them a copy of the shops FFl. as for the OP, you could find out what brand/style of pistol your friend likes and buy it at a shop local to you and have them ship it to your friends preferred FFl(again I think your shop would need a copy of your firends preferrred FFL) and then tell him to go pick it up, although he would have to pay the transfer fee. |
