Here's the question,

If one person in a household has a FOID card and is not home but there are firearms in the house what happens then? I cant find any legal answers to this question.  

My cousin is telling my grandma that she could be arrested because she doesn't have a FOID card when my grandpa isn't home...

This sounds ridicules but I wouldn't put it past Illinois government...

It sounds ridiculous because it is.   Grandpa is not required to carry his guns with him everywhere he goes.   He can leave them at home.   The only way Grandma would have a problem is if she used one of the guns to dispatch a coyote and someone called the police on her.

She wont believe it unless I have some legal proof. Quoting AR15.com to her wont do any good...

E-mail or call the ISP to get an answer right from the people that issue the card. I'm sure she'll believe the information is true when you got it directly from the ISP themselves.

If Grandpa keeps the guns in a safe inaccessible to those other than himself or those he directly authorizes, then Grandma will not be in a trouble.

I live in Chicago, so I leave my guns in the burbs with my parents. I made sure to get my Dad a FOID card though just the same.

Not an option, he has the right to protect what's his and his faimly.

I'm glad you feel safe enough to have no guns in your house.

I've heard an urban legend about a situation where a housewife interacted with an LEO who observed guns in a glass fronted gun case from the front door. He reportedly asked her if she had an FOID and when she replied no he cited her with UUW or violation of the FOID act.

No, that said, I've never been able to actually track down a case number or news article that supports this story.

Is it possible? Sure - a cop could bust you for anything whether it's legit or not.

The important point for this - or any other gun enforcement legend -  is whether there were actually charges filed from a DA, whether they survived the indictment process, if the person ever actually saw court for it and what the decision from the case and any appeals wound up being - especially if the defendant won.

leo can check the foid of a card holder, and the address is on the card - the thing is the arms should be locked up. and no under agers can have acess. and dont display guns in cases, not in illinois imho.

I suspect a gun store story.

OTOH, it does illustrate the points that

1. One should never trust LE when they appear at your door. They are not there to be your friend.
2. Valuables, including firearms, should not be on display in your home where the casual observer can see them.
3. Better that everyone in a household gets a FOID card.
