I'm sure this has been beaten to death here but being a free member on the forum I can't read past the original posts in the archive. It states that
(b)  Pursuant to Article VII, Section 6(c) of the 1970 Constitution of the State of Illinois, if this article conflicts with an ordinance of a home rule municipality, the municipal ordinance shall prevail within its jurisdiction.

So if my town doesn't mention anything about allowing or banning "assault weapons" does the CC ban take effect?

I think that Eswanson might know a bit more. Regardless, some read it that if there is any firearm ordinance in your town then it is pre-empted - of course, I'm not sure if that is the case or not.

Some other towns have very specific pre-emptions, as well. Like this one -

"It is intended that this section shall pre-empt all Cook County licensing, registration or other regulatory schemes for firearms, firearm ammunition, firearms dealers and assault weapons. As provided in Article VII, Section 6(c), of the State of Illinois Constitution of 1970, if a county ordinance conflicts with an ordinance of a municipality, the municipal ordinance shall prevail within its jurisdiction."

ETA - If your town does not have an online code list, call the police. Tell them to pull out the book for you and they will happily do so.

Yeah, the way the CC ordinance is written, if your town has laws on the books regarding AW's, then the county ordinance does not apply.  As written, it applies in unincorporated areas of the county and in towns without their own assault weapon ordinances.

Hi Eswanson,

Does it apply if your town regulates firearm dealers, but does not regulate specific weapons?
