Could this be considered an enclosed case for a handgun? Assuming that the gun is carried unloaded with a magazine in a separate compartment, would these be considered inside the real of IL. handgun laws?![]() www.maxpedition.com/store/pc/viewPrd.asp?idcategory=4&idproduct=31 I currently use it for daddy duty when I take the little one out for the day...Has enough room for a few diapers and other supplies. Question is: if I throw an unloaded hand gun in the zippered compartment, would I be within the law? |

To carry on your person is illegal and it does not matter if it is loaded or unloaded the issue is that it is concealed on or about your person. The same applies to a fanny pack. And just in case you are going to go there the transportation issue is not valid. You can not say that you are merely transporting it especially if you are out with your kids. The gun would have to be in a enclosed in a case, firearm carrying box, shipping box, or other container. It was out years ago even on TV when people thought they could carry a gun in a fanny pack or the like. Fanny packs and the like are not cases. The sheriff said anyone would be arrested. |

(10) Carries or possesses on or about his person, upon any public street, alley, or other public lands within the corporate limits of a city, village or incorporated town, except when an invitee thereon or therein, for the purpose of the display of such weapon or the lawful commerce in weapons, or except when on his land or in his own abode or fixed place of business, any pistol, revolver, stun gun or taser or other firearm, except that this subsection (a) (10) does not apply to or affect transportation of weapons that meet one of the following conditions: (i) are broken down in a non‑functioning state; or (ii) are not immediately accessible; or (iii) are unloaded and enclosed in a case, firearm carrying box, shipping box, or other container by a person who has been issued a currently valid Firearm Owner's Identification Card. |

Ill code says "case" My contention would be fat boy equipped the holster attachment is designed to be a case for a firearm. To be safe from an unpleasant experience I would not include the magazine(s) in the versa pack. Put those in in another bag. Remember also "NOT WITHIN IMMEDIATE REACH". I have been pulled over on my way to a range and have had several pistols zipped up in a range bag and loaded magazines in a separate plastic 50 caliber sized ammo case with which I threw a master lock (to cover myself legally) Here's the theory on 6 seconds to safety in Illinois Do not try to be the test case on this! 6 seconds to saftey "do not try this at home" |

Let's not forgot the word transport. Transport means to move from one place to another. Federal code usually states to transport from one legal location (your house) to another (the range). Trucks transport merchandise from one location to another. If you are walking around aimlessly you are not transporting, in theory. Not to mention you can't have any guns in bars, etc. Also, as mentioned above you have the immediately accessible clause. I would consider that immediately accessible if it is on your person. In your back seat under the back seat, no. But on your person, yes. If you are so confident then call the police as you walk down the street to report yourself. See if you get arrrested or not. |

Three things: 1. If you are asking the question you probably already know the answer. 2. If these kind of loopholes are what everyone is looking for the unfortunate ending is that the craphead bangers and thugs will be doing the same thing. That is why everyone can't do as they please and instead should start pushing more for concealed carry. 3.
