This will be interesting.

1) Colorado won't let you claim residence until you've been here for 90 days.

2) Since I am not a Colorado resident yet, I am technically (to my knowledge) a resident of the last state I lived in (VA)

3) I moved here November 3rd of last year.  90 days has not yet elapsed.

4) The job I worked while here is the same position with the same employer I had in VA.

Do I pay Colorado income tax on the income earned while living here but not as a resident in 2009??

The short answer is you always pay tax.  Nobody knows where the money goes... ;)

I have had experience similar to yours, when I moved here from CT and when I was working in NE and living here.

Honestly, Turbo Tax will keep it straight and give you the right info.

I think there is even a non resident tax form,  but I can not remember how my partial year was handled when I moved back from Hawaii.

If you earned taxable income in CO (called Colorado source income), and you file a federal tax return, you file in CO also.

CO is going to consider you a resident anyway if you have intentions to make CO your home.


A Colorado resident is a person who has made a home in Colorado, or a person whose intention is to be a Colorado resident. [ยง39-22-103(8), C.R.S.].

Form 104 w/schedule 104PN.

This schedule will let you know what portion of your income (before federal deductions/exemptions) is taxed in CO.

Go to tax colorado for info/forms etc....
