Hey Guys,

Long story short:  Brother had records expunged, and is interested in purchasing a firearm.  We are pretty sure that he will have to appeal to get is gun rights restored.  Wanted to know if anyone had a recommendation for a decent lawyer for this in Pierce County.

Just wanted to point him in the right direction so that he gets it right the first time.

Thanks!

Expungment laws vary from state to state.  If you can find the actual statute, that will give you alot of info.  In many cases, you can do the filing for yourself once the expungment has been received.  I used to work in Oregon, and their statute essentially said that if you had an expungment, it was as if the original offense never happened.  If it never happened, there would be no reason to ask for rights back, because there would not be anything that took them away.  But that was at the state level.  I don't know if the feds have a different way of looking at it.

A call to BATFE might get the federal statutes for you to read.  Otherwise, if all this statute stuff is too confusing, it really would be best to have an attorney help out so nothing is missed.

The last two times I hired an attorney, they had things flat wrong, and I ended up showing them either the bank regulations that they weren't aware of, or the financial laws they had flat wrong.  It sort of irritated me that I had to pay them even though they didn't know what they were talking about.

Applelaw out of Florida is who I used for a gun trust. I live in WA but I chose ID as the home of the trust. they have laws that affect how long they can exist that vary from state to state. Hope this helps.
