A friend was in a car accident and while she was insured, her insurance company said her car wasn’t and refused to cover her. The problem seemed to go away. This was 2 years ago and she hasn’t heard anything. Today said friend got a notice in the mail that under RCW 46.29 saying she needs to appear before judge to determine financial responsibility. The only parties named in the legal documents is her and the department of licensing. No insurance company. No other drivers.

She has a mess on her hands.

This looks like it involves her being able to legally drive in the future.

So would that be just the DMV saying she was driving without insurance?  Or is it something else?

You are only required to have liability insurance.  Sounds like she had that but not collision which would have covered her car.  Unless there is more to the story I don't see what the dealio is.

It wouldn't be hard to take copies of cashed checks and/or insurance cards showing the date of service compared to the date of the incident.

Was it some kind of out of state thing.  Is she from somewhere else and since she was in WA her insurance didn't want to cover it?

she has lived in Wash her whole life. Sounds like the state lost her paperwork...

something is missing in the story. the rcw you posted is the state law requiring us to have insurance.  her best interest is to get a lawyer. she wont beable to navigate the court system with out a lawyer or a para legals help
