Legal? Illegal? Hmmmmm - not gonna interpret , but this is the applicable law........ http://reference.pafoa.org/statutes/PA/18/I/9/908/prohibited-offensive-weapons "(a) Offense defined.––A person commits a misdemeanor of the first degree if, except as authorized by law, he makes repairs, sells, or otherwise deals in, uses, or possesses any offensive weapon. "Offensive weapons." Any bomb, grenade, machine gun, sawed-off shotgun with a barrel less than 18 inches, firearm specially made or specially adapted for concealment or silent discharge, any blackjack, sandbag, metal knuckles, dagger, knife, razor or cutting instrument, the blade of which is exposed in an automatic way by switch, push-button, spring mechanism, or otherwise, any stun gun, stun baton, taser or other electronic or electric weapon or other implement for the infliction of serious bodily injury which serves no common lawful purpose.

I carry one on duty.
I've taken them off of people when they were involved in disturbances. Having one is not illegal - because you can buy one. Using it in any manner, other than defensive, is illegal and it can be taken from you, consequentially you may be charged with PIC (possession of instrument of a crime), AGG. Assault, REAP, Prohibited offensive weapon, amongst other things. If you are thinking about buying an ASP for protection, buy a taser or OC/pepper spray instead - the courts favor them over an ASP. |

I read the law as was stated in the previous post and I'm a little confused about the legality of carrying an expandable baton for defence say against a stray dog. Of course the law states about using it in an offensive manner. I have a permit to carry but if I, or my wife has to handle an aggressive dog in our neighborhood, we'd prefer not to have to shoot it if we can avoid it. Not that I have anything against shooting the animal "I've been a hunter for 40 years" I just don't want to draw the negative attention to us that that would cause. As for defending ourselves from some thug, thats what my CCW is for. |

As for defending ourselves from some thug, thats what my CCW is for. My suggestion would be not to get any type of weapon against a dog, other than a fire arm. If a dog is attacking you, and your in fear for your safety and/or the safety of those around you and the dog makes OBVIOUS offensive moves towards you then you can take a shot. The rule of thumb (around here anyway) is that the only time you shoot a dog is when 1. the dog bit you/someone else and 2. is going to bite you/someone else again - or is trying (and hopefully you have witnesses). Obviously there is a big headache attached with this entire thing that no one should go through. My suggestion with animals is always call 911 - we get paid to deal with it, you do not. I shoot a dog, its a lot less head ache than if you do (but still a headache none the less). |

You see our Pomeranian was attacked last spring while my wife was walking it, and she's not the type to kill anything, but I'm fairly sure she would use a baton if the need presented itself again. As it was our Pom was not seriously injured, but I'm quite sure I personally, can take down all but the largest canines with a baton, my wife I can only hope she'll take my advice and carry her LCP and then use it. She never was very well versed on self defence and its been slow going, trying to training her. |

Just a little bit of a fyi, if a dog is attacking your dog, it is not a reason (technically) to shoot it. If you are VERY worried about this as being a serious problem - get yourself some OC GEL Spray or a taser. either one will do some serious damage to a dog (or person) and no one will ever fault you for using less than lethal. |
