My parents are traveling to AZ and will be staying there the month of January.  They are residents of Wisconsin and do NOT have CCW permits there or anywhere else.  My father will be traveling with a pistol and rifle for desert plinking.  Checking on things for him.

Questions:
As non-residents, are they legally permitted to open carry?
As non-residents, are the legally allowed to conceal carry?

I apologize in advance for the simple questions.  They leave tomorrow and I want to get some info back to him ASAP.

If they can legally own the gun they can open or conceal carry it in Az.
There are places they can't take a gun (bars, public buildings, schools to name a few).

You can conceal carry in a bar as of last year, you just can't drink.

To answer your questions, Yes and Yes, with the understanding that there are certain limitations specific to no CCW permit:

-They cannot carry into any establishment serving alcohol for consumption
-They cannot carry within 1000 feet of a school

A lot of people live within a thousand feet of a school (myself included.).  I have never heard of it being enforced on property surrounding a school.



I probably wouldn't open carry while taking a stroll around the school during school hours though.

This is correct. The law  says you have to have a CCW permit to carry concealed in a bar, which is pretty stupid considering you don't need a permit to carry concealed anywhere else.

4-229. Licenses; handguns; posting of notice
A. A person with a permit issued pursuant to section 13-3112 may carry a concealed handgun on the premises of a licensee who is an on-sale retailer unless the licensee posts a sign that clearly prohibits the possession of weapons on the licensed premises.

It's what I like to call a "broken tail light" law. It's not going to be enforced, unless you end up getting a jerk cop or you are being a jerk to a cop.

I would advise them to CCW, that way even if they inadvertently walk into the wrong place they will likely not get in any trouble. Parks and restaurants present the biggest risk of inadvertent infractions - in many cases you can only carry with an AZ CCW permit.

What parks are you referring to?  Last I checked, there is no public park (city, state, or even fed level) in AZ that you can't carry openly or concealed, with or without a permit.  MIGHT still be some leftover remnants of BS with regards to wildlife preserves though.  Not 100% sure on that one.

Not sure what city you're in (Phoenix was very slow to update signage, and still isn't complete, and Tucson is trying to override state law in a lot of cases as well) but state preemption is 100% overriding of any city/county ordinance with such posting.  I'd recommend letting the AZCDL know of any parks that are refusing to comply with the state law.  I had to battle the city of Phoenix for quite some time to get just a few signs updated in a park that I frequent personally, so it's not something that happens quickly, that's for sure.

But yeah, those signs are out of date, and NOT legally enforceable.  Thankfully =)
