I was driving through AZ night before last, and was stopped. I picked up a citation and released. I'd rather not go into any more details. I've got a job lined up overseas, and I need it cleared up before I go. I'm worried about this affecting my visa. If anyone can recommend a criminal lawyer, I'd really appreciate it. |
Typically you would want a lawyer that specializes in the type of citation you received.... without more details, it'll be hard for anyone to recommend a good lawyer..... |
Negative. A FELONY warrant will be issued according to LEO. Which in and of itself is quite troubling. I've done some hell raising in my younger days, but nothing to warrant a felony... I'm not trying to make a bad situation worse. I like to vote, and I like my guns, know what I mean? |
Uh, ya.. I know a felony/misdemeanor warrant would be issued. However, extradition is the key. So, since you talk about a felony warrant, what you are being charged with must be pretty heavy. But, were you issued a citation or booked or neither? Reason I'm asking, you wouldn't be given a cite if it was a felony charge. Your original post said you were cited and released. |

Even if he admitted to it, the car is mine, registered in my name, I was driving alone, and contraband was found in my car. Possession is 9/10 of the law, or some such thing. Me: "WTF is that?! Uhh....Would you believe me if I told you it wasn't mine?" BP: ![]() I'm royally pissed about the whole situation. Something fell out of his pocket, and into the space between the seat and the center console. You know, that black hole where all the spare change ends up. I already called him up, cussed him out, and told him I was going to beat the living shit out of him when I get back. If I can cut my losses and plea to a lesser charge, I will just to avoid paying $500 to fly back there. However, the lady at the court I spoke with didn't seem too friendly. Lesson learned. Choose your "friends" wisely. 2 misdemeanor charges. I was arrested, read my rights, and released on the spot. Never in cuffs. If I failed to show up to court, a felony warrant would be issued. I dunno if that is standard, or what. Like I said, I've done some stupid shit in my day, but NEVER anything that could be a felony. I was so stressed out during the incident, I thought I was going to puke on the side of the road. The more reading I do online, it just seems like a money racket. The lawyers say they can plea it down, and you don't have to show up. The court gets payed and the lawyers do, too.

Your friend left drugs in the car? I'm not surprised BP didn't believe you, hell, I don't believe you. Don't worry. Florence is hot in the summer, but very pleasant most of the year. Do you speak Spanish? It will be a real chance to learn about cultural diversity. |

the Lawyers in this town are going to cost you big time. Being this close to the boarder they have no shortage of clients to defend, and can pick and choose the cases they want. Have you asked or looked into a Public defender? most of the bust at the check points are for hundreds of pounds if yours was a small amount it should be a slap on the wrist and see ya, but you can kiss good bye to any job that requires a back ground check or clearence for a few years. good luck |
This whole thread is very confusing. First off, there are no misdemeanor charges for drugs. They are all felonies. Second off, if you have misdemeanor charges and FTA, they issue misdemeanor warrants, not felony. If you know the statute they wrote on the cite, IM it to me. Id like to get into this a little more. |

Thanks. That is what I am learning. However, a conviction on my record may affect my visa to Australia, which is the thing I am REALLY concerned about. It was a minuscule amount, not even a friggin gram...

No, don't be a smart ass and give the 'ol "warrant" line, just respectfully say that they do not have permission to search and if they ask why are you hiding something, say no I just prefer that you not search my vehicle. |

I'm screwed if I get slapped with a large fine. I'm screwed if I get a conviction on my record. But as far as jail time is concerned, I really do not think it will happen. It will be a fine, and MAYBE some probation. I'm more concerned about how this will affect my visa to go overseas. Concerning those that think I let them search my car, negative on that. The BP K9 "hit" on my car at the I-8 checkpoint. Which gives them reasonable cause to search my car. I've refused searches before. I TX DPS officer asked if I had "any guns, drugs, or large sums of cash." I told him I wish I had large sums of cash. He then asked if he could search my car. "There is no reason to search. I am not carrying anything." No big deal. We shot the shit about Sigs, I signed the speeding ticket, and was on my merry way. |
Yup sounds like illegally obtained evidence to me. K9 hits on illegals hidden in the car. |
