Thinking of building a SBR ar 15. can i buy the upper with out the paper work from the ATF and get the tax stamp later or do i have to do this before I purchase the upper.
I still dont have a lower or anything for an AR. Thanks |

Yes, you can purchase a short upper without paper work. The Grey area is "Intent". If you have the upper, and only one lower, or a lower that has no other "mate" then there could be a problem if the law were to enter your house. Would I worry about it, no, but still . |

The upper is just part(s)... no restriction.
Now here is the where everybody will start the parade, but if you have the short upper and rifle lower in which it "can" be installed, you is in possession of contraband... you can buy the upper, leave it at a friends house or some place other than same location as the lower till it is approved as SBR, then you can assemble lawfully. My situation was I just bought a 11.5/5.5 barrel, shot it till the 5320.1 came back, then just cut the 5.5" piece off.... The barrel was already in working order, sighted, reliable in the wait time for approval. |
