I'm nearing completion of an AR pistol build and would like to take it with me when I go camping in Sequoia this summer. I'll actually be on private property surrounded by National Forest. If I install a bullet button with a 10 round mag, can I legally bring it to California? I've read some of the Weapons Primer. The only AR type pistol I noticed specifically named the Bushmaster pistol. I also read the post dated 10/16/2005 8:13:52 PM MST in which Section 12276.1.4 describes what is considered to be an assualt pistol. It seems a bullet button with fixed mag will get around the description. I'm still not 100% clear if I can bring it to California legally. What say the home town boys?
My bringing the AR pistol will depend on whether or not I ever get my upper. I ordered it from RRA 1st week in January. |

Who made the lower? It sounds like you will be ok as long as it is not a "on-list" receiver and you use a 10-round magazine with a bullet button.
Bear in mind there three categories of "assault weapons" in California: Category 1 - "Roberti-Roos assault weapons list"; CA PC 12276 (a), (b), and (c). That is where the "Bushmaster Pistol" is listed. Category 2 - "AR and AK 'series' firearms"; PC 12276 (e). It doesn't matter what features (pistol grip, flash suppressor, etc) Category 1 & 2 firearms have. Even the bare receivers are considered "assault weapons". I doubt this applies to you, but if your lower model is exactly identified on either of these lists, it's "on-list". It doesn't matter if it's a stripped receiver, pistol, or rifle. Category 3 - "Features-based"; CA PC 12276.1 (a). It looks like you have this one covered with the non-detachable 10-round magazine. I built/assembled my pistol on a stripped & pistol marked lower from Spikes Tactical. I was lucky enough to buy it back in Oct 08 before the paranoia began. Unfortunately I waited a few weeks too long to purchase the other items needed for my build. The LPK and 7.5" upper was ordered from RRA in the first week Jan. I received the LPK about 6 weeks later. I'll be lucky if I get the upper by summer. The buffer tube assembly is from ACE. The bullet button would only be for the trip to CA.
According to the links you provided, mating the RRA upper to the Spikes lower shouldn't be a problem. One more question: Having a flash hider on the barrel shouldn't be a problem right? If it is, I could always put a thread protector on the end. The larger fireball would actually be a plus. |
