I have a friend in CA with an OLL and I was wondering what his options were. If for him it would be more feasible to have a single shot AR, could he build his lower with a detachable magazine, and rmove the gas tube and plug his gas block thus eliminating the gas operation? Would this config be DOJ compliant? T |

While technically legit I recommend shying away from that on an AR as the serialized lower is separable from the upper, and the upper controls mode of operation/action type, rimfire vs non rimfire, etc. And if you're gonna use detachable mags in a 22 configuration, I think it's best if your lower were factory-marked "22LR". There are essnetially THREE option open to us right now in regards to ARs. 1. Fixed mag. Most people are doing this by either replacing the push button with a nut, or by using a specialied button that has something that limits or restricts the depth at which it can be pressed (thus removing the ability for the magazine to removed with disassmebly of the rifle). This build has the most freedom as he can essentially add any standard feature to the rifle and still stay legal. Keep in mind, the magazine MUST be 10 rounds or less. 2. No pistol grip. The ONLY way to have an open magwell on a semi-auto centerfire rifle like an AR is to remove all 'evil features' on the rifle, similar to the federal AW ban. In california these features are:
So a fixed stock rifle, with nothing on the muzzle, or a muzzle brake, would be perfectly fine with an open mag well assuming he didn't install the pistol grip. There are also other grip replacements that are not pistol grips. These range from just a piece of metal to retain the safety selector spring, to grips that mimic a traditional rifl/shotgun grasp. Paul has links and reviews for most of those options at the top of the forum (I believe it's at the bottom of the links for Californian's topic). This type of build offers flexability, but still has some restrictions. 3. Single shot/bolt action. This last category is the most questionable, becuase as mentioned, even though it does not break the law, if you remove the upper it does. If your friend does decide to go this way he might want to make sure he has no other AR uppers or parts to complete his upper into a working semi-auto upper. It's not required, but it might just that added detail that makes him seem like a legit shooter and not someone who just puts the gas tube in when he wants to have fun and takes it out when he goes home. This is probably the most legally questionable build of them all, and should be a last consideration. |

Thanks for the info... I read the law and couldn't see where this would break the "letter of the law" but I know in reality it helps to know the current "interpretation of the law", especially how those who are enforcing it interpret it. I'll pass the info along. T |
