Is it leagal to kill a deer that come to your private property that is destroying crop? hope this is not a stupid question.

I don't know whether it's legal to kill them without a permit, but I do know lot's of farmers in my area easily get depredation permits (or something like that) for that very reason.

I looked into this type of thing a while ago, but I was looking into skunks and opossums that were coming in and killing/eating chickens on our ranches. I vaugely remember seeing something about protecting livestock from other animals; but I'm not sure if that still applies to vegetation.

Either way, I would not even think of touching a deer without a hunting license or when they are out of season (I don't hunt, so I don't know the seasons). Call the local wildlife and gaming offices and see what they have to say about your particular situation. Maybe they can relocate the deer without anyone or anything getting hurt.

it's even more complex than you think...

let's just say for a momment that it is legal to kill a deer destroying your crops.  however, it may not be legal to discharge a firearm where you are, so you have to check on county/city laws to about discharge of firearms...

not to say you haven't, just thought i'd throw it out there and hopefully keep some people out of trouble ;)

Someone can correct or add if I am wrong, but I believe the basic rules for California (or maybe it's just my county) is no discharing of firearms within city limits except where permitted (ranges, hunting grounds, etc), you must be at least 300 yards from any road, shooting away from any buildings. I think there were a couple other details, but that was the main part that I can remember.

So if you are within city limits, have neighbors, or have a couple roads near by; you are screwed.

i think you right, but you never know.  there might be some strange county law.  then again, i've also seen laws banning the sale and distribution of peanuts on tuesdays after sundown...

NO!!!  You need either a hunting license and valid deer tag or a depredation permit from the DFG. You can own the property but the animals belong to the state or the feds [migratory birds]

I see ...

I wasn't sure that's why i'd check with you guys before i do anything stupid.  In that case i will not hurt the deer.  How about i use a trap to trap the deer than call the DFG to come by and take that deer away?  Sound good?

 Its illegal to trap deer, you can trap nongame and small game animals in live traps but you need licenses and permits for that. Whats the problem with the deer?

The deer continuesly every night comes to my 5 acre strawberry batch and feed on it.  My parent don't want this to happen and told me to come up with the solution because if we don't do anything about this the deer will destroy the whole batch.  First it was only one deer now my parent are seeing probably about 3 deer in the field.  So, probably the dog is the only solution to the problem.  I have 2 Lab and a Bloodhound, i hope the dog can chase away the deer.

Try the labs first.  If the bloodhound is anything like my bassets, they ignore deer and eat strawberries. and tomatoes and boysenberries.  Not eggplant though, they have some standards.

yea, well, i got a clumber spaniel that LOVES celery.  Seriously.  He managed to open the fridge once, and all he took out was a stick of butter and celery.  Even though there were steaks in there...

What county are you located in?  I would definitely look into archery hunting the deer at dawn or dusk.  Archery deer season in the A zone has already been open for a week or so.  Depredation permits are pretty simple to get and you can always have an "agent" do the hunting for you.

Don't give up on hunting them yet.

Use a crossbow  and eat for a week or more afterward.
