| Hey guys, I know this probably isn't the right place to post this but i couldn't find any other section so anyways.. I'm form Omaha, NE and I'll be moving to Naples, Florida for this fall for school. Please tell me its as simple as putting my AR in its case, in my trunk with the rest of my stuff, and going to Florida? Or is it much more complicated? Thanks |

what you want to do is legal and just as simple as packing it away and bringing it down with you. The possession on campus is an area that i'm not familiar enough with to say anything other than do major research first.
but i'm not a lawyer and you should do your own research get this book and read it: Florida Firearms Law

If you're not living on campus, you're fine but at least buy some kind of secure storage and bolt it down. If you live on campus, check the campus PD and see what their storage requirements are in advance. As others have mentioned you can ship a firearm to yourself in care of yourself via US Mail (no handguns or ammo), UPS, FedEx.

Thanks Well, I'm not going to address your travel through other states, because that is pretty straight forward. The following is not legal advise. There is nothing you need to do when you arrive in Florida. You are fine. There are no restrictions off campus. Legally, you may have a handgun in your car on campus if it is securely encased. Securely encased is a legal term in Florida... Legally you can have a firearm other than a handgun anywhere in your car on campus, see below. 790.115 Possessing or discharging weapons or firearms at a school-sponsored event or on school property prohibited; penalties; exceptions.— (2)(a) A person shall not possess any firearm, electric weapon or device, destructive device, or other weapon as defined in s. 790.001(13), including a razor blade or box cutter, except as authorized in support of school-sanctioned activities, at a school-sponsored event or on the property of any school, school bus, or school bus stop; however, a person may carry a firearm: 3. In a vehicle pursuant to s. 790.25(5); except that school districts may adopt written and published policies that waive the exception in this subparagraph for purposes of student and campus parking privileges. 790.25(5) says a handgun must be securely encased (17) “Securely encased” means in a glove compartment, whether or not locked; snapped in a holster; in a gun case, whether or not locked; in a zippered gun case; or in a closed box or container which requires a lid or cover to be opened for access. 790.25(5) is more lax with long guns but is a little vague. (5) POSSESSION IN PRIVATE CONVEYANCE.—Notwithstanding subsection (2), it is lawful and is not a violation of s. 790.01 for a person 18 years of age or older to possess a concealed firearm or other weapon for self-defense or other lawful purpose within the interior of a private conveyance, without a license, if the firearm or other weapon is securely encased or is otherwise not readily accessible for immediate use. Nothing herein contained prohibits the carrying of a legal firearm other than a handgun anywhere in a private conveyance when such firearm is being carried for a lawful use. Nothing herein contained shall be construed to authorize the carrying of a concealed firearm or other weapon on the person. This subsection shall be liberally construed in favor of the lawful use, ownership, and possession of firearms and other weapons, including lawful self-defense as provided in s. 776.012. There is a recent lawsuit that went to the appeals court confirming all of this, but some of the campus cops are not up to speed so don't even ask them. 790.25 will get you started with Florida firearms law. http://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0700-0799/0790/0790ContentsIndex.html&StatuteYear=2013&Title=-%3E2013-%3EChapter%20790 |
