I have a question for all y'all arfcom Floridians. Back in NC if a store posts "No Weapons or No Carrying" we cannot carry concealed into the store. I'm sure this applies in FL. However, if a NC store posts in a manner that is hard to see, such as a very small sign in the corner of the store, it is not a valid posting and we can carry. To be clear, it must be a completely obvious posting. What are the regulations on this condition in FL? I'm visiting family in my hometown of Pensacola, and the Cordova mall has a very small and non-obvious sign in the corner of the wall by the door that says in very small print "No weapons." Does FL law still allow me to carry? What says the FL clan?

Those "No Weapons" signs carry no weight in Florida. If they aren't on the list as designated by Florida law it ain't against the law. It may be considered by some to be bad manners though.

You may carry concealed if you have a CCW or CCW reciprocity from another state. Many do it anyway where there are signs posted "knowing" they won't get caught. Now, if the store manager "sees" your concealed weapon and asks you to leave, you must do so or he may prefer trespassing charges against you. Some here don't shop where we're not welcome.

FL State Statute 790.06 (12) (a) 1-15 defines where you may not carry.

Thanks for the help. I guess I'll just have to make my own choices. I'm carrying a full-size CZ 75, so I already have to be careful since FL law prohibits the firearm being visible at all, including a barrel poking out of under a shirt. I have a long sleeve shirt with a design that blocks out the print pretty well, and is long enough to cover up the barrel, but NC's open carry law gives me more leeway. I wish my funds had opened up the possibility of the XDs I wanted...

This. There are two stores on my way to work, one has a sign that says "no weapons allowed," and the other has a sign that says "we do not accept EBT cards." Guess which one gets my business?

 



To answer your question, fpni. If you must go there, you have no legal problems to worry about.

haven't had any firsthand experience but i've heard they've kinda toned down on the whole "brandishing" thing. i do my best to keep my firearm concealed at all times but if i drop something at a store and pick it up and it shows partially for a second i'm not too worried about it.

as far as businesses, you can carry in a lot of places (other than obvious stuff like federal buildings etc.) now if a business see's your firearm they can refuse to serve you and ask you to leave or something like that.

but as the arfcom motto goes when it comes to concealed carry is "concealed is concealed". most businesses should never know you're carrying. and if for some reason they see it, most they can legally do is ask you to leave.


now that's not saying they won't throw some libtard hissy fit and panic. but yeah.


ps. i love NC, family has a cabin in Murphy, NC and i love it there.

A brief, accidental exposure is not illegal. Picking up a dropped item being a perfect example.

They haven't "toned it down," they've made it "not a crime."

FL State Statute 790.053 (1) says in part: "It is not a violation of this section for a person licensed to carry a concealed firearm as provided in s. 790.06(1), and who is lawfully carrying a firearm in a concealed manner, to briefly and openly display the firearm to the ordinary sight of another person, unless the firearm is intentionally displayed in an angry or threatening manner, not in necessary self-defense."

If a business is posted I make a point of not doing business with them but if a mall has a sign with tiny print outlining a "code of conduct" I just ignore it and enter.

I'll make an exception and go into Toys R Us although it has signage because I hate to shop for toys and want to get it done in one place as easily as possible.

Except for Toys R Us and Jared Jewelers I haven't seen any individual stores posted.
