Hey guys,
If a purchaser and a buyer are both FL residents, does the purchaser have to ship to an FFL or can he ship directly to the buyer? Both the purchaser and the seller have FL concealed weapon permits. Can the shipment be made simply through UPS or FedEx? Perfectly legal to ship firearms to any other person in Florida. As long as you do not know, or have reasonable cause to believe they are prohibited.
It's a little difficult right now, because neither UPS nor FedEx' tariffs permit shipping from/to non-FFLs. Even though many Hubs ignore that policy or are unaware of it. For interstate shipments, federal law require you to notify the carrier the package contains a firearm, but that is not the case for intrastate shipments. So you can legally not tell them what's in the package if shipping within Florida. But if it gets lost or damaged, you're out of luck because you did not follow the company policy. A CWFL has nothing to do with any of this. |
