Had the bright idea to get my dad a pistol for his birthday. I'll be splitting it with my mother but paying for it myself and setting up the transfer. We were going to surprise him this weekend by taking him to shoot and having him fill the ATF form out as the receiver of the firearm at the range.

That's legal, correct? I'll be paying when I order but it will be picked up by the end receiver and he'll be completing the transfer paperwork.

To be completely honest, this is one of those areas where a good number of FFL's will set their policy based on their own interpretation of the law, what their ATF inspector has told them to do, or a combination of the two.

Given the wide range of answers FFL's could give you on the question, I'd call the FFL you plan to use for the transfer and ask him. It'd suck to have it delivered, go in to get it, and have the FFL refuse to let either of you complete the 4473 because he fails to understand the difference between a straw purchase and a gift.

Buy the gun yourself, fill out the paperwork yourself, then hand him the gun as a bday gift later.

This.  It is perfectly legal to give a firearm as a gift; this does not invoke the "straw purchase" rules.  In fact, the instructions on the 4473 specifically state that you're to mark question 11a (are you the actual purchaser) "yes" for a gift.
