I got this question from a response to another question...let me know if I have this right. A FFL dealer (no SOT) can deal occasionally in NFA arms, just subject to $200 transfer tax. I (with FFL) could buy a dealers sample new AR to attempt to sell to local PD's. (I'm a firefighter and have substantial PD contacts). If I sell less than 3 per year it would cost less in transfer tax than in SOT to sell. Is that occasional sales of class 3? Obviously if I start getting orders for more that 3 per year I would better off getting the SOT. Is it OK for me (with FFL) to own dealers sample for occasional sales (as described above) as long as I have paid the $200 transfer tax?

Thanks, Andy No, non-SOTs cannot deal in NFA - they can, however, occasionally handle a transfer for a customer, or even purchase something for themselves, tax-paid on Form 4. This does not extend to dealer samples of any kind (pre- or post-), only to transferrable items. Only SOTs can get dealer samples - never, ever, ever, ever, ever, ever, never can a non-SOT FFL get one. If you were to somehow sell a hundred machineguns, sight-unseen, to a police department, as a non-SOT FFL; the only thing that can happen is they get drop-shipped direct to the PD on Form 5, and you maybe get a taste of the contract money. |

You can purchase anything for yourself that you want, but not being a SOT, you won't be getting any pre- or post-samples.
You fill out the paperwork, pay your $200 tax stamp, and wait like everyone else, but you can buy interstate. If buying as an individual, even with an FFL, but without SOT, you'll need CLEO signoff on the back in section 17 of the form. |
