I've got a couple of rifles up on an internet ad board that covers several states in my area.  I'm getting a few offers from guys that say  "how much for FTF if I drive to your place?"  Two of the three admitted that they are out of state.  

I've always thought that FTF transactions between two people from different states was illegal weather it was rifles or handguns.  Am I correct?


Are these guys just ignorant of the law or do they think they're finding a sucker to sell them a gun illegally?

If they are from out of state and want to come to you to buy the gun, you can go to a nearby FFL and do the transfer there. But you're right....no FTF transfer of a firearm to an out-of-state resident without a dealer being involved (unless its C&R and they have C&R FFL)

Both are possibilties, as are ATF sting operations.  They monitor gun boards pretty closely.

I just sent replies to the two inquires stating I would only ship to their FFL's as they are out of state.  One responded I was full of shit and the other wants to talk about shipping to his FFL.

If you get your FFL you hear that fairly frequently.

Here in Louisiana you can do it if the state borders Louisiana, like Texas, Arkansas, Mississippi and it can only be a long gun no handguns.

Unless still enshrined in your state's laws, the "bordering states" provision for licensees actually went away in 1986, as part of FOPA.

A resident of ANY state, may purchase a long gun from a licensee in ANY state, provided the firearm and the sale is legal under BOTH state's laws.

It is against federal law for a non-licensee to purchase a gun, be it hand or long, from an unlicensed resident of another state, even if that state borders their own.

A resident of Louisiana can legally purchase a rifle from a dealer in Texas, yes, but also from a dealer in North Dakota.

A resident of Louisiana may NOT legally purchase a rifle from a private seller in Texas, unless the transfer takes place through an FFL.

Ok you got my interest up.   I thought Fed law was ok with face to face transfers for a long gun between anyone in the 50 states.  It is state law that may further restrict this. Handguns must be transferred to a resident of which the transfer takes place including face to face.  But I've been wrong before.

From the above-linked FAQ:
Q: From whom may an unlicensed person acquire a firearm under the GCA?

   A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee’s premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.
