2 days ago, bought a rimfire long gun. During the NICS, the FFL was told that he had to be transferred to another agent. 10 seconds later, as he was reading back the transacion number, we got the proceed. Today, went to another FFL and bought another rimfire long gun. FFL called in 2 people at once. Got a delay on me, and a proceed on the other guy, 2 minutes later dring the same call, he got a proceed on me.I asked what happened. He said that I got escalated to the FBI because I was not born in the US. I was born in the US.
Should I wear a tinfoil hat now? What happened? I have bought a fewlowers and long guns this year. Double digits, but no more than 5 a week, and from a few local sellers. Always, provide a SS#. Never had any sort of delay until these last 2 transactions? It makes me leery of going to gun shows, because I don't want to have to drive an extra 200 miles because of some delay. |

He said that I got escalated to the FBI because I was not born in the US. I was born in the US. The FBI runs the NICS program, so you didn't get escalated to the FBI as you are already there. What often occurs is the initial NICS rep will give you the NTN (transaction number) and tell you to stand by for further review of the transaction by a NICS examiner (seems to be somewhat like a supervisor ) who will review the transaction. NICS will not tell the FFL WHY the transfer is delayed or denied. The 4473 has a place for "place of birth". Maybe your FFL does not recognize that state as being part of the U.S. |
| I also notice that common names need "further review". It is not a delayed response, all they do is transfer you to another person so they can go into a little more detail with your name. If you are not putting your social security number on the 4473 form this may cause a "for further review" situation. |

He said that I got escalated to the FBI because I was not born in the US. I was born in the US. You were lied to my friend. Or, it could be that the person that called it in simply doesn't know what he's talking about. They will NEVER tell the FFL why anything was done one way or the other. |

we use the on-line NICS check. There have been several times a customer will show "delay" and then a few minutes later it will appear as "proceed". As already mentioned the FBI will only tell the FFL three things: PROCEED DELAY DENIED.
One thing we have noticed is many of the security guards from the local Indian casinos are delayed. They must have a complete background check and credit report to get a gaming license and then another background check to get a license to carry a firearm. We have wondered if the delay is because of the recent background checks that were ran on the guards, all of the activity maybe trips a flag... the FBI won't say. |
