Just got a  Flemming 3 cal Sear, now if I want to put together different configurations such as a MP5SD,HK53, and HKG3k is it a form 1 that I file? I will have the tax stamp on the sear soon on a form 3 but, to put together these different options what do I need to file? The form 3 just has the sear on it with 3 different calibers, 9mm, 5.56, and .7.62x51. This is a full auto rated sear and I will not be putting any semi-auto lowers on theses different uppers that I will build so I don't think I would have to file for an SBR uppers because this is a machine gun and not a rifle. Right? Sort a like an M16 A2, I don't need to file for an SBR on a barrel less than 16" on a M16A2 because it is a machine gun and not a Rifle or am I complete wrong? On a website like autoweapons.com they have an HK53 machine gun for sale and then you can buy SBR in an HKG3K, MP5, and MP5K.

On the other configurations, if they start life as pistols, you could put the sear in and then put a stock on and be legal. If you want to run your sear in 16" barrel rifles, you don't have to do anything. If you are going to assemble them as complete short-barrel rifles, you would have to file a Form 1 for each one.

It doesn't matter the caliber listed on the sear. It can be legally installed in any roller-locked HK variant.

You don't need to have a registered SBR to have a short barrel on the gun the sear's installed in. The catch is what it is once you take the sear out.

Roller locked ? Is that like the Push Pin Swing?

( If you are going to assemble them as complete short-barrel rifles, you would have to file a Form 1 for each one.)  Sear is a Machine gun and by definition not a rifle so no need for an SBR filing but will be a complete firearm once I complete assembly, still need to fill a form 1 to show now that I have a completed firearm?


if no to the form 1 in above question then say I have my sear and build it into a MP5K, No form 1 (You don't need to have a registered SBR to have a short barrel on the gun the sear's installed in)  Now I want to also have just the uppers ( are they called uppers ?) for configurations for an MP5SD and do a quick swop with the MP5K I built with my sear or change the sear lever (is the part called the lever in the sear to change the caliber ?)  for an HK53 or HKG3K and shoot them all without having any of the uppers registered because they are all going in my sear and not by them selves a SBR because they are just barrels without a lower?

(The catch is what it is once you take the sear out) Yes the sear is not in the others variants but am not putting them in a semi and all just attaching  into my register sear as I want.

You'll certainly get the most flexibility by registering each applicable short-barreled, stocked host as an SBR.

However, it would also be possible for you to build each host as a pistol or non-rifle "firearm" first, and equip each with something like the non-stocked MP5K receiver endcap.  Then only mount a stock on that pistol or firearm when the sear pack has been installed, and remove the stock and replace the endcap before removing the sear pack.

e.g. 12" barrel G3-pattern handgun built on a virgin .308 semi receiver, and equipped with an endcap: Add sear pack, remove endcap and install stock - voila' G3K/HK51.  Remove stock and replace endcap, remove sear - voila' it's a handgun again.

All of my host guns with barrles under 16" started life as pistols and return to pistol state berofe the sear is moved to another host. However if you want host guns actually built by HK with short barrels you will have to form 1 them as SBR's if you want to remove the sear since they started out as rifles. Obviously the exception to this would be the SP89.

I had a factory 91, but I traded it off and bought more clones for sear hosts. Good clones are available and cost quite a but less than a real HK leaving more $$ for ammo.

OP Please do your due diligence in getting the correct information. Most of what you have posted is wrong. Most of your terms are wrong so correcting you is going to be difficult/you have misunderstood some responses in this thread. Your mixing up what you've heard about ar15 conversions and an HK sear. Forget everything you've heard about machineguns, each weapons system is different.
