OK - why don't you state your questions in specifics and then perhaps we can give you more responsive answers?
SBR: Have a lower engraved per ATF specs Send off a ATF Form 1 Receive your approved tax stamp/paperwork Buy your SBR upper/have one chopped/whatever - do NOT have one around without the approved paperwork and an extra lower. IMO err on the side of caution and get one after you are approved. Enjoy your SBR ATF Form 1 |

That way you can go ahead and buy/use the upper now- but do not install a stock or VFG until you get your approved/stamped form 1 back. |

A pistol lower can NEVER have had a stock on it which would allow it to be fired from the shoulder. Nor could it be readily made able to do so (such as a 6-position reciever extension on the lower without the stock body installed). If you're going to go this route, just buy one of the pistol buffer tubes (the type that frequently has the rubber around the extension). Also, a pistol can not have a VFG attached (not even the MagPul Angled ForeGrip or one installed to the left or right side of the barrel). Doing so makes your pistol an AOW, which is another form of NFA Title II weapon.
(By the way, there is no such thing as a Class III weapon. Class 3 refers to a tax status of a Federally licensed firearms dealer who deals in NFA Title 2 weapons. Title 2 is the proper term for the grouping of firearms which contains MG's, SBR's, SBS's, AOW's, DD's, and silencers.) |
