I'm a police officer in Illinois and need to know if it's legal to buy my own 10.5" upper and put it on my department lower.  Department is fine with it as long as it's legal.

LE agencies are not exempt from federal NFA law, though they do not have to pay the federal "making" tax.

Your department needs to submit a Form 1 to make and register the department lower as a Short-Barrelled Rifle. There is no tax due, no CLEO signoff, and of course no prints or photos, or certificate of citizenship, when forms are submitted by a government entity. But the Form 1 itself must still be filled out, filed and approved by BATFE before you can legally put a 10.5" upper on your department lower.

Depends on if it is a full auto lower or a semi lower. If full auto you are fine as a Machine Gun isn't a rifle. But if a semi you need a SBR or pistol lower.
