Before I go into the idea I have, I want to say that I have NOT done this already and I want to see if it is okay before I do anything.

With that out of the way, here is my idea.

I have a 9" Spikes Havoc (side load) mounted on their Chaos Stock System. My idea is this. I want to make my own shells, 37mm. I want to use a very small amount of powder to launch a capped carbord tube (empty, nothing inside). I want the tube to go about 50 feet total so that I can shoot coffee cans in my back yard. I live on roughly 9 acres, so I won't be anywhere near a house when I do this. I wanted to run this by you guys first before I do something stupid and illegal.

no offense or anything, but why is a chalk "practice" round not a DD, but a carbord tube is? I understand that any Anti-Personal would be DD, beanbags, rubber buck etc, but I would hardly consider a cardboard tube that flies 50 feet a DD. Could you please explain why my idea would need to be registered please?

A chalk practice round, in of itself is NOT a DD, but the gun firing it would be. The gun then becomes a DD over 1/2" in diameter.

The cardboard tube is also not a DD, but because you are using it as a projectile (i.e. to shoot coffee cans)  your launcher would need to be registered as it then becomes a DD over 1/2" in diameter.

Individual projectiles need to be registered if they contain more than 1/4oz of explosive or 1/4lb of propellant.

There are some exceptions, such as golfball launchers that use blanks, tennis ball launchers, etc, as long as they are not used in an anti-personal role. If you shot someone with your golf ball launcher, it would become a DD.

Blindfaith:  You may not agree with Jester's explaination but that pretty much is the ATF's ruling on this matter.  I had to DD my Spikes HAVOC for that very same reason.  Anything other than signal flares and smoke launched out of your HAVOC will turn it into a DD with very few exceptions.

it's not that I didn't like his answer, it was that I was looking for clarification as his inital answer seemed vauge. I understand now and realize that I would have to register it. I apologize to all if I seemed to come off as confrontational, I did not mean it that way at all. Thank you for the information and I really do apreciate it, I knew I could get answers from people like you guys who know the ropes better then I.

Btw mad dog, I drooled over your havic for many nights prior to getting mine. I currently have a side load 9" havic, the chaos stock, MIAD grip and some Daniel Deffense fixed iron sights for show. I will post some pics tomorrow.

BF, You do not need to register your launcher to fire smokes, flares, gas, or other non-antipersonnel projectiles out of a 37mm launcher.

Registration is only needed when firing or possessing anti-personnel ammunition with a 37mm launcher.

ATF ruling 95-3.

thanks for the clarification. What I meant by my last post was that I understand that in order to shoot projectiles , that I would have to register it. I will probably register is down the road when money frees up and I can get more into it, but for now I will stick to flares and such for now.

This is my understanding as well. I used to own a 37mm launcher, and may or may not have made 35mm film canister chalk rounds. At the time, that sort of activity was legal. ATF may have changed their opinion since then.
