To qualify as an explosive DD, the device needs to contain more than a quarter ounce of high explosive, if I recall correctly.  Thus, most gas-payload grenades would not qualify by that standard.

However, given their offensive payload, gas grenades probably fall under a host of other state and federal restrictions.

A short web search for "CS grenades" reveals a number of sources online at police supply stores.  You should probably contact one of those suppliers for further information.

The aerosol irritant types are legal in many/most jurisdictions.  Not Texas apparently if one member's experience is any indication.

I seen them for sale at ATG not to long ago for around $80. I just looked today to buy some and I can't find them there anymore. Same with the Mil smoke grenades.

That is because Mil smoke is now considered a DD item because the fuse used in the at least in the ALS brand is on the explosives list.

That is because they are sold out and have more on order. (According to ATG)
